H.F. 767 Section 1. MEDICAID MANAGED CARE —— PARTICIPATING 1 PHARMACIES AND PHARMACISTS. A Medicaid managed care 2 organization shall contract with any licensed pharmacy or 3 pharmacist located within the geographic service area of the 4 managed care organization as a participating network provider 5 if the licensed pharmacy or pharmacist agrees to comply with 6 the terms and conditions for participation in the managed care 7 organization’s network, meets and agrees to the conditions 8 for participation in the Medicaid program established by the 9 department of human services, accepts the prevailing Medicaid 10 reimbursement, and is subject to license discipline pursuant to 11 section 155A.12 or 155A.15, as applicable. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 This bill requires a Medicaid managed care organization 16 to contract with any licensed pharmacy or pharmacist located 17 within the geographic service area of the managed care 18 organization as a participating network provider if the 19 licensed pharmacy or pharmacist agrees to comply with the 20 terms and conditions for participation in the managed care 21 organization’s network, meets and agrees to the conditions 22 for participation in the Medicaid program established by the 23 department of human services, accepts the prevailing Medicaid 24 reimbursement, and is subject to license discipline. 25 -1- LSB 2359HV (2) 89 pf/rh 1/ 1
