Section
1.
REPEAL.
Section
124.510,
Code
2023,
is
repealed.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
reports
of
arrests
of
unlawful
users
of
5
scheduled
controlled
substances.

Current
law
provides
that
any
peace
officer
who
arrests
7
for
any
crime,
any
known
unlawful
user
of
the
drugs
described
8
in
schedule
I,
II,
III,
or
IV,
or
who
arrests
any
person
9
for
a
violation
of
Code
chapter
124
(controlled
substances),
10
or
charges
any
person
with
a
controlled
substance
violation
11
subsequent
to
the
person’s
arrest,
shall
within
five
days
after
12
the
arrest
or
the
filing
of
the
charge,
whichever
is
later,
13
report
the
arrest
and
the
charge
filed
to
what
was
formerly
14
the
department
of
public
health
(now
the
department
of
health
15
and
human
services).
The
peace
officer
or
any
other
peace
16
officer
or
law
enforcement
agency
which
makes
or
obtains
any
17
quantitative
or
qualitative
analysis
of
any
substance
seized
in
18
connection
with
the
arrest
of
the
person
charged,
shall
report
19
to
the
department
the
results
of
the
analysis
at
the
time
the
20
arrest
is
reported
or
at
such
later
time
as
the
results
of
21
the
analysis
become
available.
This
information
is
for
the
22
exclusive
use
of
the
division
of
narcotics
enforcement
in
the
23
department
of
public
safety,
and
shall
not
be
a
matter
of
24
public
record.
25
The
bill
repeals
the
reporting
requirement.
