is
amended
by
adding
the

new
subsection:

SUBSECTION
.
4A.
A
retailer
or
community
group
issued

a
license
pursuant
to
this
section
shall
only
sell
consumer
6
fireworks,
as
described
in
APA
87-1,
chapter
3,
within
the
two
7
calendar
weeks
immediately
preceding
the
date
on
which
the
use
8
of
consumer
fireworks
is
permitted,
whether
pursuant
to
the
9
dates
specified
in
section
727.2,
subsection
4,
paragraph
“a”
,
10
or,
if
applicable,
the
dates
specified
by
a
county
or
city
11
in
an
ordinance
or
resolution
adopted
under
section
331.301,
12
subsection
17,
or
section
364.2,
subsection
6.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

Current
law
allows
a
consumer
fireworks
seller
license
17
holder
to
sell
consumer
fireworks
between
June
1
and
July
8
18
and
between
December
10
and
January
3
each
year
at
a
permanent
19
building,
and
between
June
13
and
July
8
each
year
at
a
20
temporary
structure.

This
bill
removes
the
dates
allowed
for
consumer
fireworks
22
sales
and
instead
provides
that
a
consumer
fireworks
seller
23
license
holder
shall
only
sell
consumer
fireworks
within
the
24
two
calendar
weeks
immediately
preceding
the
date
on
which
the
25
use
of
consumer
fireworks
is
permitted,
whether
pursuant
to
26
the
dates
specified
in
the
Code
or,
if
applicable,
the
dates
27
specified
by
a
county
or
city
in
an
ordinance
or
resolution.

Under
current
law,
a
person
who
violates
the
bill
is
guilty
29
of
a
simple
misdemeanor.
A
simple
misdemeanor
is
punishable
by
30
confinement
for
no
more
than
30
days
or
a
fine
of
at
least
$65
31
but
not
more
than
$625
or
by
both.
