  4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 282.34, Code 2017, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  4A.  Subsection 1, paragraph "a", relating
  1  4 to the provision of an educational program and appropriate
  1  5 education services, shall not apply to a children's residential
  1  6 facility if the facility is utilizing the accelerated Christian
  1  7 education curriculum program as its primary curriculum on the
  1  8 effective date of this Act and the facility was in operation
  1  9 prior to the effective date of this Act.
  1 10    Sec. 2.  EFFECTIVE UPON ENACTMENT.  This Act, being deemed of
  1 11 immediate importance, takes effect upon enactment.
  1 12                           EXPLANATION
  1 13 The inclusion of this explanation does not constitute agreement with
  1 14 the explanation's substance by the members of the general assembly.
  1 15    This bill exempts a children's residential facility from
  1 16 a requirement that such a facility provide an educational
  1 17 program and appropriate education services to children residing
  1 18 therein  by contracting with the school district in which the
  1 19 children's residential facility is located, contracting with
  1 20 an accredited nonpublic school, or becoming accredited as a
  1 21 nonpublic school. To be exempt, the facility must be utilizing
  1 22 the accelerated Christian education curriculum program as its
  1 23 primary curriculum on the bill's effective date and must have
  1 24 been in operation prior to the bill's effective date.
  1 25    The bill takes effect upon enactment.
