H.F. 600 Section 1. NEW SECTION . 22A.1 Electronic publication of 1 public notices. 2 1. For purposes of this section, “governmental body” means a 3 governmental body as defined in section 21.2. 4 2. a. A governmental body or officer that is required 5 by statute to publish a notice, action, or other information 6 in a newspaper of general circulation shall, in lieu of such 7 requirements, post the notice, action, or other information on 8 the governmental body’s internet site, if the governmental body 9 maintains an internet site. 10 b. Each governmental body or officer subject to the 11 requirements of this section shall, by rule, ordinance, 12 resolution, or other official action, as appropriate, identify 13 each type of notice, action, or information that shall be 14 posted on the governmental body’s internet site in lieu of 15 publication and shall identify the location of the governmental 16 body’s office where such notices, actions, or information will 17 be available for public inspection. 18 3. A notice, action, or other information posted by a 19 governmental body or officer on a governmental body’s internet 20 site pursuant to this section shall include all information 21 otherwise required to be contained in the publication and 22 shall comply with all requirements relating to the date of 23 publication. 24 4. In posting and maintaining a notice, action, or 25 other information on a governmental body’s internet site, 26 the governmental body shall satisfy all of the following 27 requirements: 28 a. The internet site shall be available and easily 29 accessible at all times by the public. 30 b. The public shall not be charged for access to any notice, 31 action, or other information posted on the internet site 32 pursuant to this section. 33 c. The notice, action, or other information posted on the 34 internet site pursuant to this section shall be maintained 35 -1- LSB 2395YH (1) 89 ss/rn 1/ 3
H.F. 600 and accessible through the same internet site address for as 1 long as required by law or as long as such information is 2 customarily maintained by the governmental body, whichever is 3 longer. 4 5. A notice, action, or other information posted on an 5 internet site pursuant to this section by a governmental 6 body shall also be made available by the governmental body 7 in a paper format in the office of the governmental body as 8 identified pursuant to subsection 2, paragraph “b” . 9 6. Compliance with the requirements of this section shall 10 constitute compliance with the publication requirements 11 applicable to the governmental body or officer relating to the 12 notice, action, or other information posted on an internet site 13 pursuant to this section. 14 7. A governmental body shall provide a method by which 15 persons may opt to receive notices, actions, or other 16 information by electronic mail. Electronic mail addresses 17 possessed by a governmental body pursuant to this subsection 18 are not public records and are not subject to disclosure under 19 chapter 22. 20 Sec. 2. EFFECTIVE DATE. This Act takes effect July 1, 2022. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This bill provides for electronic publication of public 25 notices. 26 The bill provides that a governmental body or officer that 27 is required by statute to publish a notice, action, or other 28 information in a newspaper of general circulation shall, 29 in lieu of such requirements, post the notice, action, or 30 other information on the governmental body’s internet site, 31 if the governmental body maintains an internet site. The 32 bill requires each governmental body subject to the bill to, 33 by rule, ordinance, resolution, or other official action, 34 as appropriate, identify each type of notice, action, or 35 -2- LSB 2395YH (1) 89 ss/rn 2/ 3
H.F. 600 information that shall be posted on the governmental body’s 1 internet site in lieu of publication and to identify the 2 location of the governmental body’s office where a paper copy 3 of such notices, actions, or information will be available for 4 public inspection. The bill requires a governmental body to 5 provide a method by which persons may opt to receive notices, 6 actions, or other information by electronic mail. Electronic 7 mail addresses possessed by a governmental body for this 8 purpose are not public records subject to disclosure under Code 9 chapter 22 (examination of public records). 10 The bill takes effect July 1, 2022. 11 -3- LSB 2395YH (1) 89 ss/rn 3/ 3
