H.F. 575 Section 1. NEW SECTION . 280.16B Student seizure training 1 and response —— administration of medication. 2 1. For purposes of this section: 3 a. “Licensed health care professional” means the same as 4 provided in section 280.16. 5 b. “Seizure action plan” means a written, individualized 6 health plan designed to acknowledge and prepare for the health 7 care needs of a student diagnosed with a seizure disorder. 8 c. “Seizure medication” means medication approved by the 9 United States food and drug administration or any successor 10 agency and prescribed to a student by a licensed health care 11 professional to treat seizure disorder symptoms, including 12 medication to be administered on an emergency basis. 13 2. The board of directors of a school district and the 14 authorities in charge of an accredited nonpublic school shall 15 have at least one employee at each attendance center who has 16 received instruction on administering or assisting with the 17 self-administration of seizure medication. 18 3. Instruction pursuant to subsection 2 shall include 19 instruction on administering seizure medication and recognizing 20 the signs and symptoms of seizures and the appropriate steps 21 to be taken to respond to such signs and symptoms. Such 22 instruction shall be fully consistent with training programs 23 developed by the epilepsy foundation of America or any 24 successor organization. 25 4. The parent or guardian of a student prescribed seizure 26 medication shall do all of the following to enable a school 27 employee to administer seizure medication to or assist with the 28 self-administration of seizure medication by the student: 29 a. Provides the school district or school each school 30 year with a written authorization in a form prescribed by the 31 school district or school to administer the medication at an 32 attendance center or other school function. 33 b. Provides the school district or school each school 34 year with a written statement from a licensed health care 35 -1- LSB 2665YH (4) 88 je/jh 1/ 5
H.F. 575 professional that contains all of the following information: 1 (1) The student’s name. 2 (2) The name and purpose of the medication. 3 (3) The prescribed dosage of the medication. 4 (4) The route of administration of the medication. 5 (5) The frequency that the medication may be administered. 6 (6) The circumstances under which the medication may be 7 administered. 8 c. Provides the seizure medication to the school district or 9 school in its unopened, sealed package with the label affixed 10 by the dispensing pharmacy intact and replaces the seizure 11 medication upon depletion or expiration. 12 d. Collaborates with school district or school personnel to 13 create a seizure action plan for the student. 14 5. The school district or school shall keep the written 15 statements and seizure action plan pursuant to subsection 16 4, paragraphs “a” and “b” , on file. The school district or 17 school shall distribute the seizure action plan to any school 18 personnel or volunteers responsible for the supervision or care 19 of the student. 20 6. Every school district or school shall provide an 21 age-appropriate seizure education program to all students 22 on seizures and seizure disorders. The program shall be 23 consistent with guidelines published by the epilepsy foundation 24 of America or any successor organization. 25 7. The board of directors of a school district and the 26 authorities in charge of an accredited nonpublic school shall 27 require a minimum of one hour of self-study review of training 28 materials on recognition of and appropriate response to seizure 29 disorders by each principal, guidance counselor, and teacher 30 each school year. 31 8. The department of education, in consultation with the 32 board of medicine, the board of nursing, and the board of 33 physician assistants, shall adopt rules pursuant to chapter 34 17A to administer this section, including but not limited to 35 -2- LSB 2665YH (4) 88 je/jh 2/ 5
H.F. 575 rules establishing standards for the development and content of 1 seizure action plans, content for instruction required pursuant 2 to subsection 2, and content for self-study review pursuant to 3 subsection 7. 4 Sec. 2. STATE MANDATE FUNDING SPECIFIED. In accordance 5 with section 25B.2, subsection 3, the state cost of requiring 6 compliance with any state mandate included in this Act shall 7 be paid by a school district from state school foundation aid 8 received by the school district under section 257.16. This 9 specification of the payment of the state cost shall be deemed 10 to meet all of the state funding-related requirements of 11 section 25B.2, subsection 3, and no additional state funding 12 shall be necessary for the full implementation of this Act 13 by and enforcement of this Act against all affected school 14 districts. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill requires school boards and authorities in charge 19 of accredited nonpublic schools to have at least one employee 20 at each attendance center who has received instruction on 21 administering or assisting with the self-administration of 22 seizure medication. 23 Such instruction shall include instruction on administering 24 seizure medication and recognizing the signs and symptoms of 25 seizures and the appropriate steps to be taken to respond to 26 such signs and symptoms and shall be fully consistent with 27 training programs developed by the epilepsy foundation of 28 America or any successor organization. 29 The bill defines “seizure medication” as medication approved 30 by the United States food and drug administration or any 31 successor agency and prescribed to a student by a licensed 32 health care professional to treat seizure disorder symptoms, 33 including medication to be administered on an emergency basis. 34 The bill requires the parent or guardian of a student 35 -3- LSB 2665YH (4) 88 je/jh 3/ 5
H.F. 575 prescribed seizure medication to take actions specified in 1 the bill to enable a school employee to administer seizure 2 medication to or assist with the self-administration of seizure 3 medication by the student. 4 The parent or guardian must provide the school district 5 or school each school year with a written authorization to 6 administer the medication at an attendance center or other 7 school function. The parent or guardian must provide the 8 school district or school each school year with a written 9 statement from a licensed health care professional that 10 contains specified information about the student’s seizure 11 medication. The parent or guardian must provide the seizure 12 medication to the school district or school in its unopened, 13 sealed package with the label affixed by the dispensing 14 pharmacy intact and replace the seizure medication upon 15 depletion or expiration. The parent or guardian must 16 collaborate with school district or school personnel to create 17 a seizure action plan for the student. H.F. 575 The bill requires the department of education, in 1 consultation with the board of medicine, the board of nursing, 2 and the board of physician assistants, to adopt rules to 3 administer the bill. 4 The bill may include a state mandate as defined in Code 5 section 25B.3. The bill requires that the state cost of 6 any state mandate included in the bill be paid by a school 7 district from state school foundation aid received by the 8 school district under Code section 257.16. The specification 9 is deemed to constitute state compliance with any state mandate 10 funding-related requirements of Code section 25B.2.
