H.F. 569 Section 1. NEW SECTION . 279.73 Water bottle filling 1 stations —— lead testing —— signage. 2 1. The board of directors of a school district shall install 3 at least one water bottle filling station designed to prevent 4 exposure to lead at each attendance center for each one hundred 5 students enrolled at the attendance center. The board shall 6 annually conduct testing for the presence of lead at each 7 filling station. The board shall post the results of the 8 testing on the board’s internet site. 9 2. The board shall post a sign near each faucet in an 10 attendance center which indicates that the faucet is not 11 suitable for drinking. Such signage may indicate permitted 12 uses for such a faucet. 13 Sec. 2. Section 298.3, subsection 1, Code 2021, is amended 14 by adding the following new paragraphs: 15 NEW PARAGRAPH . n. Installation of water bottle filling 16 stations, lead testing, and posting of signage pursuant to 17 section 279.73. 18 NEW PARAGRAPH . o. Conducting testing for the presence 19 of lead in a faucet in an attendance center that is used for 20 the preparation of food or for drinking. This paragraph is 21 repealed July 1, 2023. 22 Sec. 3. Section 423F.3, subsection 6, paragraph a, Code 23 2021, is amended by adding the following new subparagraphs: 24 NEW SUBPARAGRAPH . (5) Additionally, “school infrastructure” 25 includes installation of water bottle filling stations, lead 26 testing, and posting of signage pursuant to section 279.73. 27 NEW SUBPARAGRAPH . (6) Additionally, “school infrastructure” 28 includes conducting testing for the presence of lead in a 29 faucet in an attendance center that is used for the preparation 30 of food or for drinking. This subparagraph is repealed July 31 1, 2023. 32 Sec. 4. LEAD TESTING OF SCHOOL FAUCETS. No later than June 33 30, 2023, the board of directors of a school district shall 34 conduct a test for the presence of lead in each faucet in an 35 -1- LSB 1750YH (2) 89 je/jh 1/ 3
H.F. 569 attendance center that is used for the preparation of food or 1 for drinking. The board shall post the results of the testing 2 on the board’s internet site. 3 Sec. 5. STATE MANDATE FUNDING SPECIFIED. In accordance 4 with section 25B.2, subsection 3, the state cost of requiring 5 compliance with any state mandate included in this Act shall be 6 paid by a school district from a physical plant and equipment 7 levy under section 298.2, from revenues from the secure an 8 advanced vision for education fund under chapter 423F, or any 9 funds available pursuant to federal law. This specification of 10 the payment of the state cost shall be deemed to meet all of the 11 state funding-related requirements of section 25B.2, subsection 12 3, and no additional state funding shall be necessary for the 13 full implementation of this Act by and enforcement of this Act 14 against all affected school districts. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill requires a school board to install at least one 19 water bottle filling station designed to prevent exposure to 20 lead at each attendance center for each 100 students enrolled 21 at the attendance center. The bill requires a board to 22 annually conduct testing for the presence of lead at each 23 filling station and post the results of the testing on the 24 board’s internet site. 25 The bill requires a school board to post a sign near each 26 faucet in an attendance center which indicates that the faucet 27 is not suitable for drinking. 28 The bill requires a school board to conduct a test for the 29 presence of lead in each faucet in an attendance center that is 30 used for the preparation of food or for drinking no later than 31 June 30, 2023, and post the results on the board’s internet 32 site. 33 The bill may include a state mandate as defined in Code 34 section 25B.3. The bill requires that the state cost of 35 -2- LSB 1750YH (2) 89 je/jh 2/ 3
H.F. 569 any state mandate included in the bill be paid by a school 1 district from a physical plant and equipment levy under Code 2 section 298.2, from revenues from the secure an advanced 3 vision for education fund under Code chapter 423F, or any 4 funds available pursuant to federal law. The specification 5 is deemed to constitute state compliance with any state 6 mandate funding-related requirements of Code section 25B.2. 7 The inclusion of this specification is intended to reinstate 8 the requirement of school districts to comply with any state 9 mandates included in the bill. 10 The bill authorizes school districts to use revenues from 11 the physical plant and equipment levy under Code section 298.2 12 or from the secure an advanced vision for education fund under 13 Code chapter 423F to comply with the requirements in the bill. 14 -3- LSB 1750YH (2) 89 je/jh 3/ 3
