H.F. 551 Section 1. Section 331.603, subsection 5, paragraph a, Code 1 2023, is amended to read as follows: 2 a. The governing board of the county land record information 3 system shall not enter into an agreement to provide access 4 to electronic documents or records on a batch basis unless 5 authorized by statute . The county recorder may collect 6 reasonable fees for access to electronic documents and records 7 pursuant to an agreement. The fees shall not exceed the 8 actual cost of providing access to the electronic documents 9 and records. “Actual cost” means only those expenses directly 10 attributable to providing access to electronic documents 11 and records. “Actual cost” shall not include costs such as 12 employment benefits, depreciation, maintenance, electricity, 13 or insurance associated with the administration of the office 14 of the county recorder or the county land record information 15 system. 16 Sec. 2. Section 331.604, subsection 3, paragraph a, Code 17 2023, is amended to read as follows: 18 a. Each county shall participate in the county land 19 record information system and shall comply with the policies 20 and procedures established by the governing board of the 21 county land record information system. The governing board 22 of the county land record information system shall establish 23 policies and procedures providing for, at a minimum, reasonable 24 limitations on usage, requirements for the authentication of 25 users, the prohibition of illegal or unauthorized uses, and the 26 prohibition of foreign access from a location outside of the 27 United States. 28 Sec. 3. Section 331.605B, Code 2023, is amended by adding 29 the following new subsections: 30 NEW SUBSECTION . 3. The governing board of the county 31 land record information system may enter into an agreement to 32 provide access to electronic groundwater hazard documents or 33 records on a batch basis or through an application programming 34 interface to the department of natural resources. H.F. 551 governing board of the county land record information system 1 may collect a fee for providing access to the documents or 2 records subject to the mutual agreement of the parties. 3 NEW SUBSECTION . 4. The governing board of the county 4 land record information system may enter into an agreement to 5 provide access to aggregated anonymous data. The governing 6 board of the county land record information system may collect 7 a fee for providing access to aggregated anonymous data through 8 an authorized agreement as provided in this subsection. 9 EXPLANATION 10 The inclusion of this explanation does not constitute agreement with 11 the explanation’s substance by the members of the general assembly. 12 This bill relates to access to and use of the county land 13 record information system. Current law prohibits the governing 14 board of the county land record information system (governing 15 board) from entering into an agreement to provide access 16 to electronic documents or records on a batch basis. The 17 bill authorizes such an agreement for access to electronic 18 groundwater hazard documents or records through an application 19 programming interface to the department of natural resources 20 and for access to aggregated anonymous data. The governing 21 board may collect a fee for providing access through an 22 authorized agreement. 23 Under current law, each county shall participate in the 24 county land record information system and shall comply with 25 the policies and procedures established by the governing 26 board.
