H.F. 520 Section 1. NEW SECTION . 476.59 Electric vehicle charging 1 stations. 2 1. a. It is declared to be in the public interest to 3 encourage the development of electric vehicle infrastructure 4 in the state and eliminate barriers for the provision of 5 electrical service at electric vehicle charging stations. 6 b. For purposes of this section, “electric vehicle charging 7 station” includes a commercial or public electric vehicle 8 charging station. 9 2. An electric vehicle charging station is not a public 10 utility as defined in section 476.1 and is not subject to the 11 regulation authority of the board. The sale of electricity 12 at an electric vehicle charging station for the purpose of 13 charging electric vehicles shall not constitute the resale of 14 electrical service. If an electric vehicle charging station 15 obtains electrical service from a rate-regulated electric 16 utility, the terms and conditions of electrical service 17 to the electrical vehicle charging station customer shall 18 be governed by and subject to the electric utility’s filed 19 tariff. However, a rate-regulated electric utility shall not 20 consider an electrical vehicle charging customer’s use or 21 intended use of electrical service as a basis for establishing 22 discriminatory rates, charges, terms, or conditions of service 23 for the customer, or otherwise subjecting the customer to 24 any prejudice or disadvantage, including but not limited 25 to prohibiting the customer from selling electricity on a 26 kilowatt-hour basis. 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 This bill establishes new Code section 476.59, relating 31 to the provision of electrical service at electric vehicle 32 charging stations. 33 The bill provides that it is in the public interest to 34 encourage the development of electric vehicle infrastructure in 35 -1- LSB 2696YH (1) 88 gh/rn 1/ 2

The bill defines “electric vehicle 2 charging station” to include a commercial or public charging 3 station. 4 The bill provides that an electric vehicle is not a public 5 utility and is not subject to regulation by the Iowa utilities 6 board. The sale of electricity at a charging station shall not 7 constitute the resale of electric service. If the charging 8 station obtains electrical service from a rate-regulated 9 electric utility, the electrical service shall be governed by 10 and subject to the electric utility’s filed tariff. However, 11 a rate-regulated electric utility shall not consider the use 12 of electric service by an electric vehicle charging station 13 customer as a basis of establishing discriminatory rates, 14 charges, terms, or conditions for the customer, or subjecting 15 the customer to any prejudice or disadvantage, including 16 but not limited to prohibiting the customer from selling 17 electricity on a kilowatt-hour basis. 18 -2- LSB 2696YH (1) 88 gh/rn 2/ 2
