H.F. 510 Section 1. NEW SECTION . 321.371A Discharge of visible 1 particulate emissions prohibited. 2 A person operating a diesel-powered motor vehicle on 3 a highway shall not knowingly or intentionally cause the 4 vehicle to discharge noticeably visible smoke, soot, or other 5 particulate emissions onto another motor vehicle, a person 6 riding a bicycle, or a pedestrian. This section does not 7 apply to a diesel-powered motor vehicle with a gross weight 8 of ten thousand pounds or more, a commercial motor vehicle, 9 a construction vehicle operating at a construction site, a 10 self-propelled implement of husbandry, or a farm tractor, 11 or when the discharge of smoke, soot, or other particulate 12 emissions is the result of normal acceleration or towing. 13 Sec. 2. Section 805.8A, subsection 14, Code 2019, is amended 14 by adding the following new paragraph: 15 NEW PARAGRAPH . m. Discharge of visible particulate emissions 16 violations. For violations under section 321.371A, the 17 scheduled fine is one hundred dollars. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 This bill prohibits a person operating a diesel-powered 22 motor vehicle from knowingly or intentionally causing the 23 vehicle to discharge noticeably visible smoke, soot, or other 24 particulate emissions onto another motor vehicle, a person 25 riding a bicycle, or a pedestrian. The bill does not apply to 26 a diesel-powered motor vehicle with a gross weight of 10,000 27 pounds or more, a commercial motor vehicle, a construction 28 vehicle operating at a construction site, a self-propelled 29 implement of husbandry, or a farm tractor, or when the 30 discharge of smoke, soot, or other particulate emissions is the 31 result of normal acceleration or towing.
