  1  1    Section 1.  Section 237A.13, subsection 7, paragraph c, Code
  1  2 2017, is amended to read as follows:
  1  3    c.  Families with an income of more than one hundred
  1  4 percent but not more than one two hundred forty=five percent
  1  5 of the federal poverty level whose members, for at least
  1  6 twenty=eight hours per week in the aggregate, are employed
  1  7 or are participating at a satisfactory level in an approved
  1  8 training program or educational program.
  1  9    Sec. 2.  DIRECTIVE TO DEPARTMENT OF HUMAN SERVICES ON CHILD
  1 10 CARE ASSISTANCE.  Effective January 1, 2018, the department of
  1 11 human services shall amend its administrative rules pursuant to
  1 12 chapter 17A to provide income eligibility for state child care
  1 13 assistance, according to family size for children needing basic
  1 14 care, to families whose nonexempt gross monthly income does not
  1 15 exceed 200 percent of the federal poverty level.
  1 16                           EXPLANATION
  1 17 The inclusion of this explanation does not constitute agreement with
  1 18 the explanation's substance by the members of the general assembly.
  1 19    This bill relates to the income eligibility requirements for
  1 20 the receipt of child care assistance.
  1 21    Under current law, Code section 237A.13 authorizes the
  1 22 department of human services to establish income eligibility
  1 23 requirements for recipients of state child care assistance.
  1 24 The bill directs the department of human services to amend
  1 25 its administrative rules establishing income requirements for
  1 26 children needing basic care to provide income eligibility
  1 27 according to family size at 200 percent of the federal poverty
  1 28 level. The bill correspondingly amends the poverty level
  1 29 from 145 percent to 200 percent in Code section 237A.13(7)(c)
  1 30 regarding the establishment and prioritization of a waiting
  1 31 list for child care assistance.
