H.F. 509 Section 1. Section 321.210, subsection 2, paragraph c, Code 1 2019, is amended to read as follows: 2 c. Parking violations, meaning a violation of a local 3 authority parking ordinance or a violation of sections section 4 321L.4 , section 321.366, subsection 1 , paragraph “f” , and 5 sections 321.354 through 321.361 , including section 321.358A, 6 except section 321.354, subsection 1 , paragraph “a” . 7 Sec. 2. NEW SECTION . 321.358A Electric motor vehicle 8 parking. 9 A person shall not park a motor vehicle that is not an 10 electric motor vehicle in a parking space designated for 11 charging the batteries or other energy storage devices of 12 electric motor vehicles. For purposes of this section, 13 “electric motor vehicle” means a motor vehicle equipped with 14 electrical drivetrain components that has the ability to be 15 propelled, fully or partially, by one or more electrical motors 16 using electrical energy stored in a battery or other energy 17 storage device that can be recharged by plugging into an 18 electrical outlet or electric motor vehicle charging station. 19 Sec. 3. Section 602.8103, subsection 4, paragraph k, Code 20 2019, is amended to read as follows: 21 k. Complaints, trial informations, and uniform citations 22 and complaints relating to parking violations under sections 23 321.236 , 321.239 , 321.358 , 321.358A, 321.360 , and 321.361 , one 24 year after final disposition. 25 Sec. 4. Section 602.8106, subsection 1, paragraph c, Code 26 2019, is amended to read as follows: 27 c. For filing and docketing a complaint or information or 28 uniform citation and complaint for parking violations under 29 sections 321.236 , 321.239 , 321.358 , 321.358A, 321.360 , and 30 321.361 , eight dollars, effective January 1, 2004. The court 31 costs in cases of parking meter and overtime parking violations 32 which are contested, and charged and collected pursuant 33 to section 321.236, subsection 1 , or pursuant to a uniform 34 citation and complaint, are eight dollars per information or 35 -1- LSB 1923YH (2) 88 ns/rh 1/ 2
H.F. 509 complaint or per uniform citation and complaint effective 1 January 1, 1991. 2 Sec. 5. Section 805.8A, subsection 1, Code 2019, is amended 3 by adding the following new paragraph: 4 NEW PARAGRAPH . d. For a parking violation under section 5 321.358A, the scheduled fine is fifty dollars. 6 EXPLANATION 7 The inclusion of this explanation does not constitute agreement with 8 the explanation’s substance by the members of the general assembly. 9 This bill prohibits a person from parking a motor vehicle 10 that is not an electric motor vehicle, as defined in the bill, 11 in a parking space designated for charging the batteries or 12 other energy storage devices of electric motor vehicles. A 13 violation of this provision is punishable by a scheduled fine 14 of $50. 15 The bill makes a corresponding change to Code section 16 321.210, excluding the parking violation from being considered 17 by the department of transportation for purposes of driver’s 18 license suspension. By operation of law, the parking violation 19 is also not considered for suspension of a restricted driver’s 20 license under Code section 321.178(2)(b), cancellation of 21 a motorized bicycle driver’s license under Code section 22 321.189(7)(c), revocation of a special minor’s driver’s license 23 under Code section 321.194(4), cancellation of a temporary 24 restricted license under Code section 321.215(3), or habitual 25 offender status under Code section 321.555(2). 26 The bill also makes corresponding changes to Code section 27 602.8103, relating to the clerk of court’s destruction of 28 records for parking violations, and Code section 602.8106, 29 providing for an $8 fee charged by the clerk of court to file 30 and docket complaints for parking violations. 31 -2- LSB 1923YH (2) 88 ns/rh 2/ 2
