H.F. 473 Section 1. COLLECTION OF UNEMPLOYMENT BENEFIT PAYMENTS —— 1 DISASTER EMERGENCY. Notwithstanding section 96.3, subsection 2 7, and section 96.3, subsection 10, paragraph “d”, the 3 department of workforce development shall not pursue the 4 recovery of any overpayments of unemployment insurance benefits 5 made to any individual who received such benefits to which the 6 individual was not entitled without fault on the part of the 7 individual if such benefits were paid during the period of a 8 declaration of disaster emergency by the governor pursuant to 9 section 29C.6 pertaining to COVID-19 as defined in section 10 686D.2. 11 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 12 importance, takes effect upon enactment. 13 Sec. 3. RETROACTIVE APPLICABILITY. This Act applies 14 retroactively to unemployment benefits received on or after 15 March 8, 2020. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill prohibits the department of workforce development 20 from pursuing the recovery of any overpayments of unemployment 21 insurance benefits made to any individual who received such 22 benefits to which the individual was not entitled without 23 fault on the part of the individual if such benefits were paid 24 during the period of a declaration of disaster emergency by the 25 governor pertaining to COVID-19. 26 The bill takes effect upon enactment and applies 27 retroactively to unemployment benefits received on or after 28 March 8, 2020. 29 -1- LSB 2398HH (4) 89 je/rn 1/ 1
