H.F. 415 Section 1. Section 280.5, Code 2021, is amended to read as 1 follows: 2 280.5 Display of United States flag and Iowa state flag —— 3 pledge of allegiance . 4 1. The board of directors of each public school district 5 and the authorities in charge of each nonpublic school shall 6 provide and maintain a suitable flagstaff on each school site 7 under its control, and the United States flag and the Iowa 8 state flag shall be raised on all school days when weather 9 conditions are suitable. 10 2. The board of directors of each public school district 11 shall offer the pledge of allegiance in grades one through 12 twelve each school day. Every accredited nonpublic school 13 shall offer the pledge of allegiance in grades one through 14 twelve unless the authorities in charge of the school determine 15 that the requirement conflicts with the school’s religious 16 doctrines. Each classroom in which the pledge of allegiance is 17 recited pursuant to this subsection shall display the United 18 States flag during the recitation. A student shall not be 19 compelled against the student’s objections or those of the 20 student’s parent or guardian to recite the pledge. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This bill requires that school districts and accredited 25 nonpublic schools offer the pledge of allegiance in grades one 26 through twelve each school day and display the United States 27 flag in the classroom during the recitation. An accredited 28 nonpublic school need not comply if the requirement conflicts 29 with the school’s religious doctrine. A student shall not be 30 compelled to recite the pledge against the objection of the 31 student or the objection of the student’s parent or guardian. 32 -1- LSB 2042HV (1) 89 kh/jh 1/ 1
