Section 123.53, subsection 5, Code 2015, is 1 2 amended to read as follows: 1 3 5. After any transfer provided for in subsection 3 is 1 4 made, the department of commerce shall transfer into a special 1 5 revenue account in the general fund of the state, a sum of 1 6 money at least equal tosevennine percent of the gross amount 1 7 of sales made by the division from the beer and liquor control 1 8 fund on a monthly basis but not less than nine million dollars 1 9 annually. Of the amounts transferred, two million dollars, 1 10 plus an additional amount determined by the general assembly, 1 11 shall be appropriated to the Iowa department of public health 1 12 for use by the staff who administer the comprehensive substance 1 13 abuse program under chapter 125 for substance abuse treatment 1 14 and prevention programs. Any amounts received in excess of the 1 15 amounts appropriated to the Iowa department of public health 1 16 for use by the staff who administer the comprehensive substance 1 17 abuse program under chapter 125 shall be considered part of the 1 18 general fund balance. 1 19 EXPLANATION 1 20 The inclusion of this explanation does not constitute agreement with 1 21 the explanation's substance by the members of the general assembly. 1 22 Code section 123.53(5), concerning transfers from the beer 1 23 and liquor control fund to a special fund for substance abuse 1 24 treatment and prevention programs, is amended. This bill 1 25 increases, from 7 percent to 9 percent, the percentage of the 1 26 gross amount of sales made by the alcoholic beverages division 1 27 that is transferred from the beer and liquor control fund to 1 28 the special fund.
