NEW
SECTION
.
307.48A
Overtime
leave
or
pay
1
earned
by
highway
maintenance
employees.

1.
As
used
in
this
section,
unless
the
context
otherwise
3
requires:
4
a.
“Highway
maintenance
employee”
means
an
employee
of
the
5
maintenance
bureau
of
the
department’s
operations
division
6
who
provides
maintenance
services
on
primary
roads,
including
7
but
not
limited
to
highway
technicians,
highway
technician
8
associates,
equipment
operators,
and
garage
operation
9
assistants.
10
b.
“Workweek”
means
the
seven-day
period
from
Friday
at
11
midnight
to
Thursday
at
11:59
p.m.

2.
A
highway
maintenance
employee
who
works
more
than
forty
13
hours
during
a
workweek
shall
not
be
prohibited
from
earning
14
overtime
leave
or
overtime
pay
during
the
workweek
due
to,
15
or
have
the
employee’s
overtime
leave
or
overtime
pay
earned
16
during
the
workweek
offset
by,
any
leave
taken
during
that
same
17
workweek,
including
but
not
limited
to
vacation
leave,
sick
18
leave,
compensatory
leave,
or
overtime
leave.
However,
if
a
19
highway
maintenance
employee
works
on
the
same
day
the
employee
20
has
also
taken
leave,
any
overtime
leave
or
overtime
pay
earned
21
for
the
day
may
be
offset
by
any
leave
taken
that
day.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement

the
members

the

This
bill
relates
to
overtime
leave
or
pay
earned
by
26
department
of
transportation
highway
maintenance
employees.
27
The
bill
defines
the
terms
“highway
maintenance
employee”
and
28
“workweek”.
Under
the
bill,
a
highway
maintenance
employee
29
who
works
more
than
40
hours
during
a
workweek
shall
not
be
30
prohibited
from
earning
overtime
leave
or
overtime
pay
during
31
the
workweek
due
to,
or
have
the
employee’s
overtime
leave
or
32
overtime
pay
earned
during
the
workweek
offset
by,
any
leave
33
taken
during
that
same
workweek.
However,
the
bill
provides
34
that
if
a
highway
maintenance
employee
works
on
the
same
day
