Section
1.
Section
321.31,
Code
2021,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
3.
a.
A
person
shall
not
use
information
3
obtained
from
the
systems
maintained
under
this
section,
4
including
but
not
limited
to
by
the
means
described
in
section
5
22.3,
321.10,
321.11,
321A.3,
or
622.46,
for
any
marketing
or
6
promotional
activity.

b.
A
person
who
violates
this
subsection
commits
a
simple
8
misdemeanor.

EXPLANATION
10
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
11
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
restricts
the
use
of
information
related
to
13
motor
vehicle
registration
maintained
by
the
department
of
14
transportation
and
county
treasurers.
15
Under
current
law,
the
records
systems
maintained
by
the
16
department
of
transportation
and
each
county
treasurer’s
office
17
contain
information
related
to
vehicle
registration,
including
18
information
related
to
the
vehicle,
the
vehicle
owner,
and
19
security
interests
attached
to
the
vehicle.
20
The
bill
prohibits
a
person
from
using
the
information
21
contained
in
these
records
systems
for
any
marketing
or
22
promotional
activity.
The
bill
provides
that
a
person
who
23
violates
this
provision
commits
a
simple
misdemeanor.
A
simple
24
misdemeanor
is
punishable
by
confinement
for
no
more
than
30
25
days
and
a
fine
of
at
least
$105
but
not
more
than
$855.
