1.
Section
322.3,
subsection
9,
Code
2021,
is

amended
by
striking
the
subsection.

Sec.
2.
Section
322.5,
subsection
3,
Code
2021,
is
amended

to
read
as
follows:

3.
A
motor
vehicle
dealer
may
also,
upon
receipt
of
a
5
temporary
permit
approved
by
the
department,
display
and
sell
6
classic
cars
only
at
county
fairs,
as
defined
in
chapter
174
,
7
vehicle
shows,
and
vehicle
exhibitions
which
have
been
approved
8
by
the
department
for
purposes
of
classic
car
display
and
sale
9
and
the
provisions
of
section
322.3,
subsection
9
,
shall
not
be
10
applicable
.
Application
for
a
temporary
permit
shall
be
made
11
on
forms
provided
by
the
department
and
shall
be
accompanied
by
12
a
ten-dollar
permit
fee.
A
permit
shall
be
issued
for
a
single
13
period
of
not
to
exceed
five
days.
Not
more
than
three
permits
14
may
be
issued
to
a
motor
vehicle
dealer
in
any
one
calendar
15
year.
For
purposes
of
this
subsection
,
“classic
car”
means
a
16
motor
vehicle
fifteen
years
old
or
older
but
less
than
twenty
17
years
old
which
is
primarily
of
value
as
a
collector’s
item
and
18
not
as
transportation.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
21
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
licensed
motor
vehicle
dealers
are
23
prohibited
from
engaging
in
the
business
of
buying
or
selling
24
at
retail
new
or
used
motor
vehicles
on
Sunday,
except
25
dealers
may
display
and
sell
classic
cars
at
county
fairs,
26
vehicle
shows,
and
vehicle
exhibitions
on
any
day
of
the
week
27
pursuant
to
a
temporary
permit
approved
by
the
department
of
28
transportation.

This
bill
removes
the
Sunday
sales
prohibition
for
licensed
30
motor
vehicle
dealers.

A
person
who
violates
the
provisions
of
Code
section
32
322.3
(prohibited
acts)
is
subject
to
denial,
suspension,
or
33
revocation
of
the
dealer’s
license.
A
person
who
violates
34
the
provisions
of
Code
chapter
322
is
guilty
of
a
simple
