  1  1    Section 1.  Section 321.362, Code 2017, is amended to read
  1  2 as follows:
  1  3    321.362  Unattended motor vehicle.
  1  4    1.  No A person driving or in charge of a motor vehicle shall
  1  5 not permit it the vehicle to stand unattended without first
  1  6 stopping the engine, or when standing unless the vehicle is
  1  7 locked or, if it is impossible to lock the vehicle while the
  1  8 vehicle's engine is running, the vehicle is equipped with a
  1  9 theft alarm signal device or other antitheft device and such
  1 10 device is in operation.
  1 11    2.  A person driving or in charge of a motor vehicle shall
  1 12 not permit the vehicle to stand unattended upon any perceptible
  1 13 grade without effectively setting the brake thereon and turning
  1 14 the front wheels to the curb or side of the highway.
  1 15                           EXPLANATION
  1 16 The inclusion of this explanation does not constitute agreement with
  1 17 the explanation's substance by the members of the general assembly.
  1 18    Current law prohibits a person from permitting a vehicle to
  1 19 stand unattended without first stopping the engine, or without
  1 20 effectively setting the brake and turning the front wheels to
  1 21 the curb or side of the highway when the vehicle is standing
  1 22 upon any perceptible grade. A violation of this provision is
  1 23 punishable by a scheduled fine of $20.
  1 24    This bill permits a motor vehicle to stand unattended
  1 25 without first stopping the engine if the vehicle is locked or,
  1 26 if it is impossible to lock the vehicle while the vehicle's
  1 27 engine is running, the vehicle is equipped with a theft alarm
  1 28 signal device or other antitheft device and such device is in
  1 29 operation.
