1.
NEW
SECTION
.
237D.1
Definitions.
1
As
used
in
this
chapter,
unless
the
context
otherwise
2
requires:
3
1.
“Child”
means
the
same
as
defined
in
section
237A.1.
4
2.
“Child
care”
means
the
same
as
defined
in
section
237A.1.
5
3.
“Child
development
home”
means
the
same
as
defined
in
6
section
237A.1.
7
4.
“Department”
means
the
department
of
human
services.

“Facility”
means
the
same
as
defined
in
section
237A.1.

“Fund”
means
the
child
care
center
and
child
development
10
home
grant
fund.

“Home”
means
a
child
development
home.

“Licensed
child
care
center”

“center”
means
a
facility

providing
child
care
or
preschool
services
for
seven
or
more

that
has
been
issued
a
license
by
the
department

Child
care
center
and
child

development
home
grant
fund.

1.
A
child
care
center
and
child
development
home
grant
fund
21
is
created
and
established
as
a
separate
and
distinct
fund
in
22
the
state
treasury
under
the
control
of
the
department.
23
2.
a.
The
fund
may
consist
of
any
moneys
appropriated
by
24
the
general
assembly
for
purposes
of
this
chapter
and
any
other
25
moneys
that
are
lawfully
available
to
the
department.
Moneys
26
in
the
fund
are
appropriated
to
the
department
and
shall
be
27
used
for
the
purposes
of
this
chapter.
28
b.
Notwithstanding
section
8.33,
moneys
in
the
fund
29
that
remain
unencumbered
or
unobligated
at
the
close
of
the
30
fiscal
year
shall
not
revert
but
shall
remain
available
for
31
expenditure
for
the
purposes
of
this
section
in
succeeding
32
fiscal
years.
Notwithstanding
section
12C.7,
subsection
2,
33
interest
earned
on
moneys
in
the
fund
shall
be
credited
to
the

fund.

Child
care
center
and
child

development
home
grant
program.

1.
The
department
shall
adopt
rules
to
establish
and
3
administer
a
child
care
center
and
child
development
home
4
grant
program
to
provide
for
the
allocation
of
money
in
the
5
fund
in
the
form
of
grants,
not
to
exceed
fifty
thousand
6
dollars
per
grant,
to
eligible
persons
for
costs
related
to
7
the
establishment
of
a
new
licensed
child
care
center
or
8
a
new
child
development
home,
or
for
the
expansion
of
an
9
existing
licensed
child
care
center
or
the
expansion
of
an
10
existing
child
development
home.
For
any
one
fiscal
year,
the
11
department
shall
not
approve
more
than
four
million
dollars
12
in
grants.
The
rules
adopted
by
the
department
shall
specify
13
the
eligibility
requirements
for
applicants
of
the
program
and
14
the
items
eligible
for
a
program
grant.
Items
eligible
for
a
15
program
grant
must
include
the
costs
related
to
licensing
or
16
registration,
supplies,
and
infrastructure.

2.
A
new
center
or
a
new
home
must
be
licensed
or
registered
18
and
fully
operational
within
two
years
of
the
date
of
an
19
applicant’s
receipt
of
a
grant.
20
3.
Of
the
children
for
whom
a
new
or
expanded
center
or
a
21
new
or
expanded
home
provide
child
care,
a
minimum
of
twenty
22
percent
of
the
children
must
be
from
a
family
that
qualifies
23
for
state
child
care
assistance
pursuant
to
section
237A.13.

4.
A
person
that
is
awarded
a
grant
shall
enter
into
an
25
agreement
with
the
department
that
specifies
the
requirements
26
that
must
be
maintained
throughout
the
period
of
the
agreement
27
in
order
for
the
person
to
retain
the
grant.
The
agreement
28
must
contain,
at
a
minimum,
provisions
addressing
all
of
the
29
following:
30
a.
The
legal
name
of
the
person
receiving
the
grant.
31
b.
The
amount
of
the
grant.
32
c.
Annual
certification
by
the
person
to
the
department
of
33
compliance
with
the
requirements
of
the
agreement,
the
program,
34
and
this
chapter.

repayment
of
the
grant,
or
a
portion
of
the
grant,

if
the
person
does
not
meet
all
of
the
requirements
of
the

agreement,
the
program,
and
this
chapter.

If
a
new
center
or
a
new
home
for
which
the
grant
was
4
received
goes
out
of
business
within
two
years
of
the
date
the
5
new
center
or
new
home
becomes
fully
operational
pursuant
to
6
subsection
2,
the
grant
shall
be
subject
to
repayment.
If
an
7
expanded
center
or
an
expanded
home
for
which
the
grant
was
8
received
goes
out
of
business
within
two
years
of
the
date
on

which
the
grant
was
received,
the
grant
shall
be
subject
to
10
repayment.

This
bill
relates
to
the
establishment
of
a
grant
program
and
15
grant
fund
administered
by
the
department
of
human
services
to
16
provide
grants
for
new
or
expanded
licensed
child
care
centers
17
and
new
or
expanded
registered
child
development
homes.
18
The
bill
creates
a
child
care
center
and
child
development
19
home
grant
fund
(fund)
in
the
state
treasury
under
the
control
20
of
the
department
of
human
services
(department).
The
fund
21
consists
of
any
moneys
appropriated
by
the
general
assembly
and
22
any
other
moneys
that
are
lawfully
available
to
the
department.
23
Moneys
in
the
fund
are
appropriated
to
the
department
to
24
be
used
for
the
purposes
of
a
child
care
center
and
child
25
development
home
grant
program
(program).
Moneys
in
the
fund
26
that
remain
unencumbered
or
unobligated
at
the
close
of
the
27
fiscal
year
do
not

but
remain

program

any
one
fiscal
1
year,
the
department
cannot
approve
more
than
$4
million
in
2
grants.
“Licensed
child
care
center”
and
“child
development
3
home”
are
defined
in
the
bill.
The
rules
adopted
by
the
4
department
must
specify
the
eligibility
requirements
for
5
applicants
to
the
program
and
the
items
eligible
for
grant
6
funding.
Costs
related
to
licensing
or
registration,
supplies,
7
and
infrastructure
must
be
eligible
for
grant
funding.

A
new
center
or
a
new
home
is
required
by
the
bill
to
be
9
licensed
or
registered
and
fully
operational
within
two
years
10
of
the
date
of
a
person’s

of
a
grant.
Of
the
children

for
whom
the
new
center,
the
new
home,
the
expanded
center,
or
12
the
expanded
home
provide
child
care,
a
minimum
of

percent

of
the
children
must
be
from
a
family
that

The
bill
requires
a
person
that
is
awarded
a
grant
to

specifying
