H.F. 2506 Section 1. Section 709.9, Code 2020, is amended to read as 1 follows: 2 709.9 Indecent exposure —— masturbation . 3 1. A person who exposes the person’s genitals or pubes pubic 4 area to another not the person’s spouse, or who commits a sex 5 act in the presence of or view of a third person, commits a 6 serious misdemeanor , if all of the following apply : 7 1. a. The person does so to arouse or satisfy the sexual 8 desires of either party ; and . 9 2. b. The person knows or reasonably should know that the 10 act is offensive to the viewer. 11 2. a. A person who masturbates in public in the presence of 12 or view of another, not a child, commits a serious misdemeanor. 13 b. A person who masturbates in public in the presence of or 14 view of a child commits an aggravated misdemeanor. 15 c. For the purpose of this subsection, “masturbate” means 16 the rubbing or other physical stimulation of a person’s own 17 genitals or pubic area for the purpose of sexual gratification 18 or arousal of the person, regardless of whether the genitals or 19 pubic area is exposed or covered. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill expands the offense of indecent exposure to 24 include a person who masturbates in public in the presence of 25 or view of another, not a child, and a person who masturbates 26 in public in the presence of or view of a child. 27 The bill provides that a person who masturbates in public 28 in the presence or view of another, not a child, commits a 29 serious misdemeanor. A person who masturbates in public in 30 the presence of or view of a child commits an aggravated 31 misdemeanor. 32 The bill defines “masturbate” as the rubbing or other 33 physical stimulation of a person’s own genitals or pubic area 34 for the purpose of sexual gratification or arousal of the 35 -1- LSB 5318HV (3) 88 hf/rh 1/ 2
