H.F. 2482 Section 1. Section 35C.6, Code 2022, is amended to read as 1 follows: 2 1. No person holding a public position by appointment or 3 employment, and belonging to any of the classes of persons 4 to whom a preference is granted under this chapter , shall 5 be removed from such position or employment except for 6 incompetency or misconduct shown after a hearing, upon due 7 notice, upon stated charges, and with the right of such 8 employee or appointee to a review by a writ of certiorari or at 9 such person’s election, to judicial review in accordance with 10 the terms of the Iowa administrative procedure Act, chapter 11 17A , if that is otherwise applicable to their case. Upon 12 removal from such position or employment, the person shall be 13 provided written notification of the right of such employee 14 or appointee to a review by a writ of certiorari or judicial 15 review. A review by a writ of certiorari shall be filed within 16 three hundred days of the removal of the employee or appointee. 17 2. Upon a showing of good cause, a court shall seal 18 materials submitted to it in relation to the review of a 19 decision to remove a veteran pursuant to this section that the 20 court determines to be confidential in nature, including but 21 not limited to documents relating to a person’s medical history 22 or health, financial information, and personal identifying 23 information. 24 EXPLANATION 25 The inclusion of this explanation does not constitute agreement with 26 the explanation’s substance by the members of the general assembly. 27 This bill requires a court to seal materials submitted to 28 it in relation to the review of a decision to remove a veteran 29 from a public position to which the veteran was appointed or 30 employed if the court determines the materials are confidential 31 in nature, including but not limited to documents relating to a 32 person’s medical history or health, financial information, and 33 personal identifying information. 34 -1- LSB 5824HV (2) 89 dg/rn 1/ 1
