H.F. 2450 Section 1. Section 29C.23, subsection 1, Code 2020, is 1 amended to read as follows: 2 1. The statewide interoperable communications system shall 3 be under the joint purview of the department of public safety 4 and the department of transportation of homeland security 5 and emergency management . The departments department shall 6 jointly submit a biannual report to the statewide interoperable 7 communications system board established in section 80.28 , 8 beginning July 1, 2016 2020 . 9 Sec. 2. Section 80.5, subsection 5, Code 2020, is amended 10 to read as follows: 11 5. a. The department shall operate such radio broadcasting 12 stations as may be necessary in order to disseminate 13 information which will make possible the speedy apprehension 14 of lawbreakers, as well as such other information as may be 15 necessary in connection with the duties of the department. 16 b. The department shall issue portable or mobile radios to 17 a peace officer according to the needs of each peace officer. 18 Each peace officer shall individually determine the officer’s 19 specific communication needs to maximize the safety of the 20 public. The department shall provide individual programming of 21 portable or mobile radios according to the communication needs 22 of each peace officer. 23 Sec. 3. NEW SECTION . 80.5A Law enforcement area 24 frequencies. 25 1. The department shall hold or renew as applicable a 26 federal communications commission license for existing law 27 enforcement area frequencies and shall maintain, in operational 28 condition, communications centers and repeaters within law 29 enforcement areas. A frequency, communications center, or 30 repeater shall only be decommissioned if all sheriffs of all 31 counties within a law enforcement area certify in writing to 32 the department that the frequency, communications center, or 33 repeater in the law enforcement area is no longer of use to law 34 enforcement in those counties. H.F. 2450 “law enforcement area” means an area defined by the department 1 as utilizing one of twelve very high frequencies operated by 2 the department. 3 2. This section is repealed January 1, 2025. 4 Sec. 4. Section 80.28, Code 2020, is amended to read as 5 follows: 6 80.28 Statewide interoperable communications system board —— 7 established —— members. 8 1. For the purposes of this section and section 80.29, 9 “interoperability” means the ability of public safety and 10 public service personnel to communicate and to share data on an 11 immediate basis when authorized. 12 1. 2. A statewide interoperable communications system 13 board is established, under the joint purview of the department 14 and the state department of transportation of homeland security 15 and emergency management . The board shall develop, implement, 16 and oversee policy, operations, and fiscal components of 17 communications interoperability efforts at the state and local 18 level, and coordinate with similar efforts at the federal 19 level, with the ultimate objective of improving, developing , 20 and overseeing the operation of a statewide integrated public 21 safety communications interoperability system. For the 22 purposes of this section and section 80.29 , “interoperability” 23 means the ability of public safety and public services 24 personnel to communicate and to share data on an immediate 25 basis, on demand, when needed, and when authorized. 26 2. 3. The board shall consist of nineteen twenty-three 27 voting members, as follows: 28 a. The following members representing state agencies: 29 (1) One member representing the department of public 30 safety. 31 (2) One member representing the state department of 32 transportation. 33 (3) One member representing the department of homeland 34 security and emergency management. 35 -2- LSB 5633YH (8) 88 hf/rh 2/ 8
H.F. 2450 (4) One member representing the department of corrections. 1 (5) One member representing the department of natural 2 resources. 3 (6) One member representing the Iowa department of public 4 health. 5 (7) (6) One member representing the office of the chief 6 information officer created in section 8B.2 . 7 (8) One member representing the Iowa law enforcement 8 academy created in section 80B.4 . 9 b. The governor shall solicit and consider recommendations 10 from professional or volunteer organizations in appointing the 11 following members: 12 (1) Two members who are representatives from municipal 13 police departments. 14 (2) Two members who are representatives of sheriff’s 15 offices. 16 (3) Two members who are representatives from fire 17 departments. One of the members shall be a volunteer fire 18 fighter and the other member shall be a paid fire fighter. 19 (4) Two members who are law communication center managers 20 employed by state or local government agencies. 21 (5) One member representing local emergency management 22 coordinators. 23 (6) One member representing emergency medical service 24 providers. 25 (7) One at-large member. 26 b. The following members representing professional or 27 volunteer organizations, as follows: 28 (1) One member representing the Iowa state police officer’s 29 council who is a peace officer employee of the department of 30 public safety. 31 (2) One member representing the Iowa state police officer’s 32 council who is a peace officer employee of the department of 33 natural resources. 34 (3) One member representing the Iowa emergency management 35 -3- LSB 5633YH (8) 88 hf/rh 3/ 8
H.F. 2450 association. 1 (4) One member representing the Iowa state sheriffs and 2 deputies association. 3 (5) One member representing the Iowa state police 4 association. 5 (6) One member representing the Iowa peace officers 6 association. 7 (7) One member representing the Iowa firefighters 8 association. 9 (8) One member representing the Iowa professional 10 firefighters association. 11 (9) One member representing the Iowa emergency medical 12 services association. 13 (10) One member representing the Iowa chapter of the 14 association of public safety communications officials. 15 (11) One member representing the Iowa chapter of the 16 national emergency number association. 17 c. Six members representing each of the six homeland 18 security planning regions designated by the department of 19 homeland security and emergency management. 20 (1) The director of the department of homeland security and 21 emergency management shall organize a biannual election in each 22 of the six regions to be held by July 1 of each even-numbered 23 year. The director shall promulgate uniform rules for the 24 election. 25 (2) The director shall notify each public safety answering 26 point within each region of the rules, location, date, and time 27 of the election for the region. 28 (3) The director or the director’s designee shall preside 29 at each election. 30 (4) The director shall notify the statewide interoperable 31 communications system board of the elected regional members. 32 3. 4. In addition to the voting members, the board 33 membership shall include four members of the general assembly 34 with one member designated by each of the following: the 35 -4- LSB 5633YH (8) 88 hf/rh 4/ 8
H.F. 2450 majority leader of the senate, the minority leader of the 1 senate, the speaker of the house of representatives, and the 2 minority leader of the house of representatives. A legislative 3 member serves for a term as provided in section 69.16B in an ex 4 officio, nonvoting capacity and is eligible for per diem and 5 expenses as provided in section 2.10 . 6 4. 5. The voting members of the board shall be appointed in 7 compliance with sections 69.16 and 69.16A . Members shall elect 8 a chairperson and vice chairperson from the board membership, 9 who shall serve two-year terms. The members appointed by the 10 governor shall be appointed to three-year staggered terms 11 and the terms shall commence and end as provided by section 12 69.19 . The chairperson and vice chairperson shall initially be 13 elected between July 1, 2020, and January 1, 2021. Subsequent 14 elections shall be held each odd-numbered year. If a vacancy 15 occurs among the voting members, a successor shall be appointed 16 to serve the unexpired term. A successor shall be appointed in 17 the same manner and subject to the same qualifications as the 18 original appointment to serve the unexpired term. The voting 19 members of the board are entitled to receive reimbursement 20 for actual expenses incurred while engaged in the performance 21 of official duties from funds appropriated to the department 22 of public safety and the state department of transportation 23 homeland security and emergency management for that purpose. 24 The departments shall enter into an agreement to provide 25 administrative assistance and support to the board. 26 Sec. 5. Section 80.29, Code 2020, is amended to read as 27 follows: 28 80.29 Board duties. 29 The statewide interoperable communications system board 30 established in section 80.28 shall: 31 1. Implement and maintain organizational and operational 32 elements of the board, including staffing and program activity. 33 2. Review and monitor communications interoperability 34 performance and service levels on behalf of agencies. 35 -5- LSB 5633YH (8) 88 hf/rh 5/ 8
H.F. 2450 3. Establish, monitor, and maintain appropriate policies 1 and protocols to ensure that interoperable communications 2 systems function properly. 3 4. Allocate and oversee state appropriations or other 4 funding received for interoperable communications. 5 5. Identify sources for ongoing, sustainable, longer-term 6 funding for communications interoperability projects, including 7 available and future assets that will leverage resources 8 and provide incentives for communications interoperability 9 participation, and develop and obtain adequate funding 10 in accordance with a communications interoperability 11 sustainability plan. 12 6. Develop and evaluate potential legislative solutions to 13 address the funding and resource challenges of implementing 14 statewide communications interoperability initiatives. 15 7. 5. Develop a statewide integrated public safety 16 communications interoperability system that allows for 17 shared communications systems and costs, takes into account 18 infrastructure needs and requirements, improves reliability, 19 and addresses liability concerns of the shared network. 20 8. 6. Investigate data and video interoperability systems. 21 9. 7. Expand, maintain, and fund consistent, periodic 22 training programs for current communications systems and 23 for the statewide integrated public safety communications 24 interoperability system as it is implemented. 25 10. 8. Expand, maintain, and fund stakeholder education, 26 public education, and public official education programs 27 to demonstrate the value of short-term communications 28 interoperability solutions, and to emphasize the importance 29 of developing and funding long-term solutions, including 30 implementation of the statewide integrated public safety 31 communications interoperability system. 32 11. Identify, promote, and provide incentives for 33 appropriate collaborations and partnerships among 34 government entities, agencies, businesses, organizations, 35 -6- LSB 5633YH (8) 88 hf/rh 6/ 8
H.F. 2450 and associations, both public and private, relating to 1 communications interoperability. 2 12. Provide incentives to support maintenance and expansion 3 of regional efforts to promote implementation of the statewide 4 integrated public safety communications interoperability 5 system. 6 13. In performing its duties, consult with representatives 7 of private businesses, organizations, and associations on 8 technical matters relating to data, video, and communications 9 interoperability; technological developments in private 10 industry; and potential collaboration and partnership 11 opportunities. 12 14. 9. Submit a report by January 1, annually, to the 13 members of the general assembly regarding communications 14 interoperability efforts, activities, and effectiveness at the 15 local and regional level, and shall include a status report 16 regarding the development of a statewide integrated public 17 safety communications interoperability system, and funding 18 requirements relating thereto. 19 EXPLANATION 20 The inclusion of this explanation does not constitute agreement with 21 the explanation’s substance by the members of the general assembly. 22 COMMUNICATIONS SYSTEMS. This bill directs the department 23 of public safety to issue portable or mobile radios to peace 24 officers of the department of public safety according to 25 each peace officer’s determination of the officer’s specific 26 communication needs. The bill also directs the department to 27 provide individual programming of portable or mobile radios 28 according to the communication needs of each peace officer. 29 The bill directs the department to hold or renew federal 30 communications commission licenses for all existing law 31 enforcement area frequencies and to maintain all communications 32 centers and repeaters until January 1, 2025. The bill allows 33 the department to decommission a frequency, communications 34 center, or repeater before that date only if all sheriffs of 35 -7- LSB 5633YH (8) 88 hf/rh 7/ 8
H.F. 2450 all counties within that specific law enforcement area certify 1 to the department in writing that the frequency, communications 2 center, or repeater is no longer of use to law enforcement 3 officers in those counties. 4 STATEWIDE INTEROPERABLE COMMUNICATIONS SYSTEM BOARD. The 5 bill transfers the statewide interoperable communications 6 system board from the purview of the department of public 7 safety and the department of transportation to the department 8 of homeland security and emergency management. The bill 9 increases the number of voting members on the board, removing 10 some designated members of relevant organizations and adding 11 others. The bill provides a procedure to elect representatives 12 from each of the six homeland security planning regions, and 13 provides election procedures for the chairperson and vice 14 chairperson of the board.
