H.F. 2381 Section 1. Section 125.74, Code 2020, is amended to read as 1 follows: 2 125.74 Preapplication screening assessment —— program. 3 Prior to filing an application pursuant to section 125.75 , 4 the clerk of the district court or the clerk’s designee shall 5 inform the interested person referred to in section 125.75 6 about the option of requesting a preapplication screening 7 assessment through a preapplication screening assessment 8 program, if available. The state court administrator shall 9 prescribe practices and procedures for implementation of the 10 preapplication screening assessment program. 11 Sec. 2. Section 602.1209, subsection 16, Code 2020, is 12 amended by striking the subsection. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 Code section 125.74 provides that prior to filing an 17 application for the involuntary commitment or treatment of a 18 person with a substance-related disorder or for the involuntary 19 hospitalization of a person, the clerk of the district court or 20 the clerk’s designee shall inform the interested person about 21 the option of requesting a preapplication screening assessment 22 through a preapplication screening assessment program, if 23 available.
