H.F. 2357 Section 1. Section 321.105A, subsection 2, paragraph c, 1 Code 2014, is amended by adding the following new subparagraph: 2 NEW SUBPARAGRAPH . (31) A motor vehicle transferred to a 3 nonprofit entity which is exempt from federal income taxation 4 pursuant to section 501(c)(3) of the Internal Revenue Code 5 in a transaction in which no consideration is given, to be 6 reconditioned by the nonprofit entity for donation to a needy 7 individual served by the nonprofit entity. 8 Sec. 2. NEW SECTION . 321.118 Donated vehicles. 9 The annual registration fee is ten dollars for a motor 10 vehicle transferred to a nonprofit entity which is exempt 11 from federal income taxation pursuant to section 501(c)(3) 12 of the Internal Revenue Code in a transaction in which no 13 consideration is given, to be reconditioned by the nonprofit 14 entity for donation to a needy individual served by the 15 nonprofit entity. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill establishes an annual registration fee of $10 for 20 a motor vehicle that is transferred to a nonprofit entity in 21 a transaction involving no consideration, to be reconditioned 22 by the nonprofit entity for donation to a needy individual. 23 In addition, the bill provides an exemption from the fee for 24 new registration for such a vehicle. When the vehicle is 25 transferred from the nonprofit entity to the donee, the annual 26 registration fee would be the regular registration fee for the 27 vehicle. 28 -1- LSB 5725HV (3) 85 dea/nh 1/ 1
