H.F. 2289 Section 1. NEW SECTION . 68A.507 Declaration of voluntary 1 campaign expenditure limitation. 2 1. A candidate for the senate or house of representatives 3 may submit to the general assembly a declaration that the 4 candidate will not expend more than the following amounts 5 during the course of the candidate’s campaign, including 6 expenditures made during both primary and general elections: 7 a. For a candidate for the senate, one hundred thousand 8 dollars. 9 b. For a candidate for the house of representatives, fifty 10 thousand dollars. 11 2. A declaration described in subsection 1 shall be 12 submitted to the general assembly no later than three days 13 following the date upon which the candidate receives a 14 nomination or makes a filing under chapter 43, 44, or 45 to 15 have the candidate’s name placed on a ballot for election to 16 the senate or house of representatives. 17 3. A candidate who has submitted a declaration described 18 in subsection 1 shall submit all reports that the candidate or 19 the candidate’s committee are required to submit to the board 20 pursuant to section 68A.402 subsequent to the submission of the 21 declaration to the president of the senate, for a candidate for 22 the senate, or to the speaker of the house of representatives, 23 for a candidate for the house of representatives. 24 4. a. The president of the senate shall monitor campaign 25 expenditures by candidates for the senate who have submitted 26 a declaration described in subsection 1 and shall inform the 27 senate if a candidate who has submitted such a declaration 28 has made expenditures totaling more than one hundred thousand 29 dollars. 30 b. The speaker of the house of representatives shall 31 monitor campaign expenditures by candidates for the house of 32 representatives who have submitted a declaration described in 33 subsection 1 and shall inform the house of representatives 34 if a candidate who has submitted such a declaration has made 35 -1- LSB 5952YH (2) 88 ss/jh 1/ 2
H.F. 2289 expenditures totaling more than fifty thousand dollars. 1 5. A violation of this section is not subject to a penalty 2 pursuant to section 68A.701. 3 EXPLANATION 4 The inclusion of this explanation does not constitute agreement with 5 the explanation’s substance by the members of the general assembly. 6 This bill relates to voluntary campaign expenditure 7 limitations for candidates for the Iowa senate and house 8 of representatives. The bill allows a candidate for the 9 Iowa senate or house of representatives to submit to the 10 general assembly a declaration that the candidate will make 11 expenditures totaling less than $100,000 for the senate, 12 or $50,000 for the house of representatives. A candidate 13 who submits such a declaration shall submit reports that 14 the candidate is required to submit to the Iowa ethics and 15 campaign disclosure board, and the president of the senate, 16 for a candidate for the senate, or the speaker of the 17 house of representatives, for a candidate for the house of 18 representatives shall monitor the total amount of expenditures. 19 The president of the senate shall inform the senate if a 20 candidate for the senate who has submitted a declaration has 21 made campaign expenditures exceeding $100,000, and the speaker 22 of the house of representatives shall inform the house of 23 representatives if a candidate for the house of representatives 24 who has submitted a declaration has made campaign expenditures 25 exceeding $50,000. 26 A violation of the bill is not subject to a criminal penalty 27 for a violation of Code chapter 68A. 28 -2- LSB 5952YH (2) 88 ss/jh 2/ 2
