H.F. 2288 Section 1. NEW SECTION . 43.17 Disqualification of certain 1 candidates. 2 A person who files an affidavit of candidacy pursuant to this 3 chapter shall not file an affidavit of candidacy pursuant to 4 chapter 44 or 45 for the same office in the same election. 5 Sec. 2. Section 44.4, subsection 1, Code 2020, is amended by 6 adding the following new paragraph: 7 NEW PARAGRAPH . c. Notwithstanding paragraph “a” , 8 nominations for candidates for nonpartisan offices described in 9 section 39.21 which are required to be filed in the office of 10 the commissioner shall be filed in that office not more than 11 ninety-two days nor later than 5:00 p.m. on the sixty-ninth day 12 before the date of the general election. 13 Sec. 3. EFFECTIVE DATE. This Act, being deemed of immediate 14 importance, takes effect upon enactment. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill relates to the conduct of elections. 19 The bill prohibits a person who files an affidavit of 20 candidacy to be a partisan candidate for an office in an 21 election from filing an affidavit of candidacy to be a 22 candidate for a nonparty political organization or to be 23 nominated by petition for the same office in the same election. 24 The bill changes the filing deadline for nominations for 25 nonpartisan offices which are required to be filed in the 26 office of the county commissioner of elections from not later 27 than 5:00 p.m. on the 74th day before the first Tuesday after 28 the first Monday in June in each even-numbered year to not 29 later than 5:00 p.m. on the 69th day before the date of the 30 general election. 31 The bill takes effect upon enactment. 32 -1- LSB 6276YH (5) 88 ss/jh 1/ 1
