1.
Section
237A.13,
subsection
7,
paragraph
c,
Code

2020,
is
amended
to
read
as
follows:

c.
Families
with
an
income
of
more
than
one
hundred
3
percent
but
not
more
than
one
two
hundred
forty-five
percent
4
of
the
federal
poverty
level
whose
members,
for
at
least
5
twenty-eight
hours
per
week
in
the
aggregate,
are
employed
6
or
are
participating
at
a
satisfactory
level
in
an
approved
7
training
program
or
educational
program.

ASSISTANCE.

1.
The
department
of
human
services
shall
amend
its
11
administrative
rules
pursuant
to
chapter
17A
to
do
all
of
the
12
following:
13
a.
Provide
income
eligibility
for
state
child
care
14
assistance,
according
to
family
size
for
children
needing
basic
15
care,
to
families
whose
nonexempt
gross
monthly
income
does
not
16
exceed
two
hundred
percent
of
the
federal
poverty
level.

b.
Adjust
the
state
child
care
assistance
copayment
18
schedule
in
incrementally
increased
amounts
for
families
whose
19
nonexempt
gross
monthly
income
does
not
exceed
two
hundred
20
percent
of
the
federal
poverty
level.

2.
The
rules
adopted
pursuant
to
this
section
shall
take
22
effect
January
1,
2021.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
25
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
state
child
care
assistance,
including
27
income
eligibility
and
waiting
list
guidelines
and
copayment
28
requirements.

The
state
child
care
assistance
program
is
administered
by
30
the
department
of
human
services.
Based
upon
the
availability
31
of
the
funding
appropriated
for
state
child
care
assistance
32
for
a
fiscal
year,
the
department
establishes
waiting
33
lists
for
state
child
care
assistance
in
descending
order
34
of
prioritization.
Under
current
law,
one
of
the
waiting

list
requirements
relates
to
families
with
an
income
of
1
more
than
100
percent
but
not
more
than
145
percent
of
the
2
federal
poverty
level
whose
members,
for
at
least
28
hours
3
per
week
in
the
aggregate,
are
employed
or
are
participating
4
at
a
satisfactory
level
in
an
approved
training
program
or
5
educational
program.
The
bill
increases
this
waiting
list
6
income
eligibility
limit
from
145
percent
to
200
percent.

The
bill
directs
the
department
of
human
services
to
amend
8
its
administrative
rules
to
provide
income
eligibility
for
9
state
child
care
assistance,
according
to
family
size
for
10
children
needing
basic
care,
to
families
whose
nonexempt
11
gross
monthly
income
does
not
exceed
200
percent
of
the
12
federal
poverty
level.
The
bill
also
directs
the
department
13
to
adjust
the
state
child
care
assistance
copayment
schedule
14
in
incrementally
increased
amounts
for
such
families.
The
15
administrative
rules
adopted
by
the
department
shall
be
16
effective
January
1,
2021.
