H.F. 2283 Section 1. Section 257.11, subsection 4, Code 2022, is 1 amended to read as follows: 2 4. At-risk programs and alternative schools. 3 a. In order to provide additional funding to school 4 districts for programs serving at-risk pupils, alternative 5 program and alternative school pupils in secondary schools, and 6 pupils identified as potential dropouts or returning dropouts 7 as defined in section 257.39 , a supplementary weighting plan 8 for such pupils is adopted. A supplementary weighting of 9 forty-eight ten-thousandths per pupil as specified in paragraph 10 “b” , subparagraph (1), shall be assigned to the percentage of 11 pupils in a school district enrolled in grades one through six, 12 as reported by the school district on the basic educational 13 data survey for the base year, who are eligible for free 14 and reduced price meals under the federal National School 15 Lunch Act and the federal Child Nutrition Act of 1966, 42 16 U.S.C. §1751-1785, multiplied by the budget enrollment in the 17 school district; and a supplementary weighting of one hundred 18 fifty-six one-hundred-thousandths per pupil as specified in 19 paragraph “b” , subparagraph (2), shall be assigned to pupils 20 included in the budget enrollment of the school district. 21 Amounts received as supplementary weighting under this 22 subsection shall be utilized by a school district to develop 23 or maintain at-risk pupils’ programs, alternative programs and 24 alternative school programs, and returning dropout and dropout 25 prevention programs approved pursuant to section 257.40 . 26 b. (1) Notwithstanding paragraph “a” , a school district 27 which received supplementary weighting for an alternative high 28 school program for the school budget year beginning July 1, 29 1999, shall receive an amount of supplementary weighting for 30 the next three The per pupil supplementary weighting under 31 paragraph “a” assigned to each pupil who is eligible for free 32 and reduced price meals for school budget years beginning on or 33 after July 1, 2021, is as follows: 34 (1) (a) For the budget year beginning July 1, 2000 2021 , 35 -1- LSB 5701YH (2) 89 md/jh 1/ 5
H.F. 2283 the greater of the amount of supplementary weighting determined 1 pursuant to paragraph “a” , or sixty-five percent of the amount 2 received for the budget year beginning July 1, 1999 six hundred 3 forty-two one-hundred-thousandths per pupil . 4 (2) (b) For the budget year beginning July 1, 2001 2022 , 5 the greater of the amount of supplementary weighting determined 6 pursuant to paragraph “a” , or forty percent of the amount 7 received for the budget year beginning July 1, 1999 seven 8 hundred five one-hundred-thousandths per pupil . 9 (3) (c) For the budget year beginning July 1, 2002 2023 , 10 and succeeding budget years, the amount of supplementary 11 weighting determined pursuant to paragraph “a” seven hundred 12 sixty-eight one-hundred-thousandths per pupil . 13 (d) For the budget year beginning July 1, 2024, 14 and each succeeding budget year, eight hundred thirty 15 one-hundred-thousandths per pupil. 16 (2) The per pupil supplementary weighting under paragraph 17 “a” assigned to each pupil in the budget enrollment of the 18 school district for school budget years beginning on or after 19 July 1, 2021, is as follows: 20 (a) For the budget year beginning July 1, 2021, two hundred 21 four one-hundred-thousandths per pupil. 22 (b) For the budget year beginning July 1, 2022, two hundred 23 twenty-four one-hundred-thousandths per pupil. 24 (c) For the budget year beginning July 1, 2023, two hundred 25 forty-four one-hundred-thousandths per pupil. 26 (d) For the budget year beginning July 1, 2024, two hundred 27 sixty-four one-hundred-thousandths per pupil. 28 c. If a school district receives an amount pursuant to 29 paragraph “b” which exceeds the amount the district would 30 otherwise have received pursuant to paragraph “a” , the 31 department of management shall annually determine the amount 32 of the excess that would have been state aid and the amount 33 that would have been property tax if the school district had 34 generated that amount pursuant to paragraph “a” , and shall 35 -2- LSB 5701YH (2) 89 md/jh 2/ 5
H.F. 2283 include the amounts in the state aid payments and property tax 1 levies of school districts. The department of management shall 2 recalculate the supplementary weighting amount received each 3 year to reflect the amount of the reduction in funding from one 4 budget year to the next pursuant to paragraph “b” , subparagraphs 5 (1) through (3). It is the intent of the general assembly that 6 when weights are recalculated under this subsection , the total 7 amounts generated by each weight shall be approximately equal. 8 d. c. Amounts that a school district receives as 9 supplementary weighting pursuant to this subsection or as a 10 modified supplemental amount received under section 257.41 11 may be used in the budget year for purposes of providing 12 district-wide, building-wide, or grade-specific at-risk and 13 dropout prevention programming targeted to pupils who are not 14 deemed at risk. 15 e. d. Notwithstanding paragraph “d” “c” and section 16 282.24 , if a pupil has been determined by the school district 17 to be likely to inflict self-harm or likely to harm another 18 pupil and all of the following apply, the school district may 19 use amounts received pursuant to paragraph “a” to pay the 20 instructional costs necessary to address the pupil’s behavior 21 during instructional time when those services are not otherwise 22 provided to pupils who do not require special education and the 23 costs exceed the costs of instruction of pupils in a regular 24 curriculum: 25 (1) The pupil does not require special education. 26 (2) The pupil is not in a court-ordered placement under 27 chapter 232 under the care and custody of the department of 28 human services or juvenile court services. 29 (3) The pupil is not in the state training school pursuant 30 to a court order entered under chapter 232 under the care and 31 custody of the department of human services. 32 (4) The pupil is not placed in a facility licensed under 33 chapter 135B , 135C , or 135H . 34 Sec. 2. Section 257.41, subsection 1, Code 2022, is amended 35 -3- LSB 5701YH (2) 89 md/jh 3/ 5

The budget of an adopted program for at-risk 2 students, secondary students who attend alternative programs 3 or alternative schools, or returning dropouts and dropout 4 prevention for a school district, after subtracting funds 5 received under section 257.11, subsection 4 , paragraphs “a” 6 through “c” and “b” , and from other sources for that purpose, 7 including any previous carryover or amount designated from the 8 school district’s flexibility account under section 298A.2, 9 subsection 2 , shall be funded annually on a basis of one-fourth 10 or more from the district cost of the school district and up to 11 three-fourths through establishment of a modified supplemental 12 amount. Annually, the department of management shall establish 13 a modified supplemental amount for each such school district 14 equal to the difference between the approved budget for the 15 program for that district and the sum of the amount funded from 16 the district cost of the school district plus funds received 17 under section 257.11, subsection 4 , and from other sources 18 for that purpose, including any previous carryover or amount 19 designated from the school district’s flexibility account under 20 section 298A.2, subsection 2 . 21 Sec. 3. Section 257.41, subsection 2, paragraph e, Code 22 2022, is amended to read as follows: 23 e. Costs incurred for programs authorized under section 24 257.11, subsection 4 , paragraph “d” “c” . 25 Sec. 4. EFFECTIVE DATE. This Act, being deemed of immediate 26 importance, takes effect upon enactment. 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 Under Code section 257.11(4), supplementary weighting is 31 assigned to specified populations of pupils in order to provide 32 additional funding to school districts for programs serving 33 at-risk pupils, alternative program and alternative school 34 pupils in secondary schools, and pupils identified as potential 35 -4- LSB 5701YH (2) 89 md/jh 4/ 5
H.F. 2283 dropouts or returning dropouts. Separate supplementary 1 weightings are assigned to pupils enrolled in grades one 2 through six, who are eligible for free and reduced price meals 3 under the federal National School Lunch Act and the federal 4 Child Nutrition Act of 1966, and to those pupils included in 5 the school district’s budget enrollment. This bill modifies 6 the supplementary weighting amounts assigned to each specified 7 group of pupils. 8 For school budget years beginning on or after July 1, 2021, 9 the bill specifies the supplementary weighting amounts for 10 pupils eligible for free and reduced price meals as follows: 11 (1) for the budget year beginning July 1, 2021, 0.00642 per 12 pupil; (2) for the budget year beginning July 1, 2022, 0.00705 13 per pupil; (3) for the budget year beginning July 1, 2023, 14 0.00768 per pupil; and (4) for the budget year beginning July 15 1, 2024, and each succeeding budget year, 0.00830 per pupil. 16 For school budget years beginning on or after July 1, 2021, 17 the bill specifies the supplementary weighting amounts for 18 pupils who are part of the school district’s budget enrollment 19 as follows: (1) for the budget year beginning July 1, 2021, 20 0.00204 per pupil; (2) for the budget year beginning July 1, 21 2022, 0.00224 per pupil; (3) for the budget year beginning 22 July 1, 2023, 0.00244 per pupil; and (4) for the budget year 23 beginning July 1, 2024, and each succeeding budget year, 24 0.00264 per pupil. 25 The bill also strikes obsolete provisions and makes 26 corresponding changes to other provisions of law. 27 The bill takes effect upon enactment. 28 -5- LSB 5701YH (2) 89 md/jh 5/ 5
