H.F. 2265 Section 1. NEW SECTION . 155A.32A Dispensing of prescription 1 drugs as prescribed —— penalty. 2 1. If a practitioner prescribes a prescription drug that 3 is approved by the United States food and drug administration, 4 including for off-label use, and indicates on the prescription 5 that no drug product selection in accordance with section 6 155A.32 shall be made, a pharmacist shall dispense the specific 7 prescription drug to the patient in accordance with the 8 prescription. 9 2. A pharmacist who violates this section by refusing to 10 dispense a prescription drug as specified in subsection 1 is 11 guilty of an aggravated misdemeanor. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 This bill relates to the dispensing by a pharmacist of a 16 prescription drug as prescribed. 17 Under the bill, if a practitioner prescribes a prescription 18 drug that is approved by the United States food and drug 19 administration, including for off-label use, and indicates on 20 the prescription that no drug product selection shall be made, 21 a pharmacist shall dispense the specific prescription drug to 22 the patient in accordance with the prescription. 23 A pharmacist who violates the bill by refusing to dispense 24 a prescription drug as specified in the bill is guilty of 25 an aggravated misdemeanor.
