EDUCATIONAL SERVICES FOR INCARCERATED JUVENILES 1 2 AWAITING TRIAL == DEPARTMENT OF EDUCATION STUDY AND REPORT. 1 3 1. The department of education shall conduct a study of 1 4 educational services provided across the state to juveniles 1 5 incarcerated by a state or local law enforcement agency while 1 6 awaiting trial. The department shall consider all applicable 1 7 state and federal laws, rules, regulations, and court rulings 1 8 to determine whether educational services currently being 1 9 provided comply with applicable legal requirements. A state or 1 10 local law enforcement agency shall comply with any request for 1 11 information submitted by the department as part of the study. 1 12 2. The department of education shall submit a report on 1 13 its findings and recommendations to the general assembly and 1 14 the governor no later than January 4, 2019. The report shall 1 15 include any best practices for providing educational services 1 16 to juveniles incarcerated by a state or local law enforcement 1 17 agency while awaiting trial, any recommended policy changes 1 18 by state or local law enforcement agencies to ensure that all 1 19 applicable legal requirements are followed, and any recommended 1 20 legislation on this subject. 1 21 EXPLANATION 1 22 The inclusion of this explanation does not constitute agreement with 1 23 the explanation's substance by the members of the general assembly. 1 24 This bill requires the department of education to conduct 1 25 a study of educational services provided across the state to 1 26 juveniles incarcerated by a state or local law enforcement 1 27 agency while awaiting trial. The bill requires the department 1 28 to consider all applicable state and federal laws, rules, 1 29 regulations, and court rulings to determine whether educational 1 30 services currently being provided comply with applicable 1 31 legal requirements. The bill requires state and local law 1 32 enforcement agencies to comply with any request for information 1 33 submitted by the department as part of the study. 1 34 The bill requires the department to submit a report on its 1 35 findings and recommendations to the general assembly and the 2 1 governor no later than January 4, 2019.
