H.F. 2217 Section 1. Section 22.7, Code 2020, is amended by adding the 1 following new subsection: 2 NEW SUBSECTION . 74. Documents submitted to the Iowa 3 ethics and campaign disclosure board to verify the information 4 contained in a lobbyist’s client’s report pursuant to section 5 68B.38. 6 Sec. 2. Section 68B.38, Code 2020, is amended to read as 7 follows: 8 68B.38 Lobbyist’s client reporting. 9 1. On or before July 31 of each year, a lobbyist’s 10 client shall electronically file with the general assembly 11 board a report that contains information on all salaries, 12 fees, retainers, and reimbursement of expenses paid by the 13 lobbyist’s client to the lobbyist for lobbying purposes during 14 the preceding twelve calendar months, concluding on June 30 15 of each year , as well as all documents necessary to verify 16 the information in the report . The amount reported to the 17 general assembly board shall include the total amount of all 18 salaries, fees, retainers, and reimbursement of expenses paid 19 to a lobbyist for lobbying both the legislative and executive 20 branches. 21 2. The chief clerk of the house and the secretary of the 22 senate board shall establish an internet site for the filing of 23 lobbyist’s client reports in an electronic format. 24 2A. The board shall verify the information submitted in the 25 report filed pursuant to this section. The board may require 26 a lobbyist’s client to provide additional documents necessary 27 to verify the information, which a lobbyist’s client shall 28 provide. The documents provided pursuant to this section and 29 used for verification shall be kept confidential. 30 3. The chief clerk of the house and the secretary of 31 the senate board shall post all lobbyist’s client reports 32 filed pursuant to this section in a searchable database on an 33 internet site. H.F. 2217 lobbyist’s client report information on the general assembly’s 1 board’s internet site. 2 EXPLANATION 3 The inclusion of this explanation does not constitute agreement with 4 the explanation’s substance by the members of the general assembly. 5 This bill relates to lobbyist’s client reports. 6 Under current law, a lobbyist’s client is annually required 7 to file with the general assembly a report that contains 8 information on all salaries, fees, retainers, and reimbursement 9 of expenses the lobbyist’s client paid to the lobbyist for 10 lobbying purposes during the preceding year. The bill requires 11 that the reports are instead filed with the Iowa ethics and 12 campaign disclosure board (board). The bill also requires a 13 lobbyist’s client to submit all documents necessary to verify 14 the information and the board to verify the information. The 15 board may require a lobbyist’s client to provide additional 16 documents, which the client must provide. Verification 17 documents a lobbyist’s client submits to the board are 18 confidential. The first report for which the provisions of 19 the bill will apply is due by July 31, 2020, for the reporting 20 period of July 1, 2019, through June 30, 2020. 21 A person who knowingly and intentionally violates a 22 provision of the bill is guilty of a serious misdemeanor and 23 may be reprimanded, suspended, or dismissed from the person’s 24 position or otherwise sanctioned. A serious misdemeanor is 25 punishable by confinement for no more than one year and a fine 26 of at least $315 but not more than $1,875. 27 -2- LSB 5808YH (3) 88 jh/tm 2/ 2
