Section
1.
Section
159A.11,
Code
2020,
is
amended
by
adding

the
following
new
subsection:

SUBSECTION

“E-15
plus”
means
ethanol
blended

gasoline
designated
as
at
least
E-15
or
higher
as
specified
in
4
section
214A.2
but
is
not
E-85
gasoline
as
defined
in
section
5
214A.1.

Sec.
2.
Section
159A.14,
subsection
1,
paragraph
a,
7
subparagraph
(1),
subparagraph
division
(a),
Code
2020,
is

amended
to
read
as
follows:

(a)
Store
and
dispense
E-15
plus
gasoline.
At
least
for
10
the
period
beginning
on
September
16
and
ending
on
May
31
of
11
each
year,
the
ethanol
infrastructure
must
be
used
to
store
and
12
dispense
E-15
plus
gasoline
as
a
registered
fuel
recognized
by
13
the
United
States
environmental
protection
agency.

APPROPRIATION.

1.
There
is
appropriated
from
the
general
fund
of
the
state
17
to
the
department
of
agriculture
and
land
stewardship
to
be

deposited
in
the
renewable
fuel
infrastructure
fund
created
in
19
section
159A.16
for
the
fiscal
year
beginning
July
1,
2019,
and
20
ending
June
30,
2020,
the
following
amount,
or
so
much
thereof
21
as
is
necessary,
to
be
used
for
the
purposes
designated:

For
purposes
of
providing
cost-share
moneys
under
the
23
renewable
fuel
infrastructure
program
for
retail
motor
fuel

sites
as
provided
in
section
159A.14:

The
moneys
appropriated

subsection

3.
Notwithstanding
section
8.33,
moneys
appropriated
in

this
Act
that
remain
unencumbered
or
unobligated
at
the
close

of
the
fiscal
year
shall
not
revert
but
shall
remain
available
33
for
expenditure
for
the
purposes
specified
in
this
section
34
until
the
close
of
the
succeeding
fiscal
year.

EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate

importance,
takes
effect
upon
enactment.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

GENERAL.
This
bill
amends
provisions
establishing
the
6
renewable
fuel
infrastructure
program
(program)
administered
by
7
the
department
of
agriculture
and
land
stewardship
(DALS),
by
8
allowing
the
state
to
finance,
on
a
cost-share
basis,
payments
9
to
support
retail
motor
fuel
sites
when
installing
facilities
10
that
store
and
dispense
gasoline
designated
as
at
least
E-15
11
or
higher
but
is
not
E-85
gasoline,
which
the
bill
defines
as
12
E-15
plus.
The
bill
appropriates
moneys
from
the
general
fund
13
to
DALS
to
be
deposited
in
the
renewable
fuel
infrastructure
14
fund
for
the
2019-2020
fiscal
year
to
be
used
to
install
motor
15
fuel
blender
pumps
capable
of
dispensing
gasoline
designated
as
16
E-15
plus.
The
moneys
are
to
remain
available
for
expenditure
17
for
the
2020-2021
fiscal
year.

BACKGROUND.
Motor
fuel
and
motor
fuel
pumps
are
regulated
by
19
DALS,
including
blender
pumps
that
dispense
a
combination
of
20
two
or
more
types
of
gasoline
which
may
be
stored
in
different
21
tanks,
including
ethanol
blended
gasoline
(Code
chapters
214
22
and
214A).
The
program
supports
the
improvement
of
retail
23
motor
fuel
sites
that
install,
replace,
or
convert
motor
fuel
24
storage
and
dispensing
infrastructure
associated
with
ethanol
25
blended
gasoline.
Ethanol
blended
gasoline
is
classified
26
according
to
its
designation
in
which
E-xx
is
the
volume
27
percent
of
ethanol
in
the
ethanol
blended
gasoline.
