Section 124.414, subsection 1, paragraph b, Code 1 2 2018, is amended to read as follows: 1 3 b. "Drug paraphernalia" does not include hypodermic needles 1 4 or syringes if manufactured, delivered, sold, or possessed for 1 5 a lawful purpose. "Lawful purpose" includes hypodermic needles 1 6 or syringes delivered, sold, or possessed through an approved 1 7 syringe services program established pursuant to rules adopted 1 8 by the department of public health. 1 9 Sec. 2. Section 135.19, Code 2018, is amended by adding the 1 10 following new subsection: 1 11 NEW SUBSECTION. 3. The department shall establish and 1 12 implement a syringe services program for persons who unlawfully 1 13 inject controlled substances and who are at an increased risk 1 14 for exposure to hepatitis B or hepatitis C. The program 1 15 shall include hepatitis C testing, referrals for treatment 1 16 of substance use disorders, and training for opioid overdose 1 17 prevention and reversal. 1 18 Sec. 3. Section 141A.3, subsection 2, Code 2018, is amended 1 19 by adding the following new paragraph: 1 20 NEW PARAGRAPH. g. Establish and implement a syringe 1 21 services program for persons who unlawfully inject controlled 1 22 substances and who are at risk of HIV infection. The program 1 23 shall include testing for HIV infection, referrals for 1 24 treatment of substance use disorders, and training in opioid 1 25 overdose prevention and reversal. 1 26 EXPLANATION 1 27 The inclusion of this explanation does not constitute agreement with 1 28 the explanation's substance by the members of the general assembly. 1 29 This bill relates to the criminal offense of manufacturing, 1 30 delivering, selling, or possessing drug paraphernalia and the 1 31 establishment of a syringe exchange program. 1 32 Currently, a person who illegally manufactures, delivers, 1 33 sells, or possesses drug paraphernalia commits a simple 1 34 misdemeanor under Code section 124.414. Current law also 1 35 provides that "drug paraphernalia" does not include hypodermic 2 1 needles or syringes if manufactured, delivered, sold, or 2 2 possessed for a lawful purpose. The bill specifies that 2 3 "lawful purpose" includes hypodermic needles or syringes 2 4 delivered, sold, or possessed through an approved syringe 2 5 services exchange program established pursuant to rules adopted 2 6 by the department of public health. 2 7 The bill provides that the Iowa department of public health 2 8 shall establish and implement a syringe services program for 2 9 persons who unlawfully inject controlled substances and who are 2 10 at an increased risk for exposure to hepatitis B or hepatitis 2 11 C.
