H.F. 2205 Section 1. SHORT TITLE. This Act shall be known as 1 “Evelyn’s Law”. 2 Sec. 2. NEW SECTION . 135E.1 Definitions. 3 As used in this chapter, unless the context otherwise 4 requires: 5 1. “Department” means the department of inspections and 6 appeals. 7 2. “Electronic monitoring” means the placement and use of an 8 electronic monitoring device by a resident in the resident’s 9 room in accordance with this subchapter. 10 3. “Electronic monitoring device” means a camera or other 11 device that captures, records, or broadcasts audio, video, 12 or both, that is placed in a resident’s room and is used to 13 monitor the resident or activities in the room. 14 4. “Nursing facility” means the same as defined in section 15 135C.1, and includes the portion of the Iowa veterans home 16 licensed as a nursing facility under chapter 135C. 17 5. “Resident” means an individual admitted to a nursing 18 facility. 19 6. “Resident representative” means one of the following in 20 the order of priority listed, to the extent the person may 21 reasonably be identified and located: 22 a. The attorney in fact designated to make treatment 23 decisions for the resident in accordance with chapter 144B. 24 b. The guardian of the resident if one has been appointed 25 pursuant to chapter 633. 26 c. The resident’s spouse. 27 d. An adult child of the resident or, if the resident has 28 more than one adult child, a majority of the adult children who 29 are reasonably available. 30 e. A parent of the resident, or parents if both are 31 reasonably available. 32 f. An adult sibling of the resident. 33 Sec. 3. NEW SECTION . 135E.2 Electronic monitoring. 34 1. H.F. 2205 electronic monitoring of the resident’s room through the use of 1 an electronic monitoring device placed in the resident’s room 2 pursuant to this chapter. 3 2. Nothing in this section precludes the use of electronic 4 monitoring otherwise allowed by law. 5 Sec. 4. NEW SECTION . 135E.3 Consent to electronic 6 monitoring. 7 1. Except as otherwise provided in this chapter, a resident 8 must consent to electronic monitoring in the resident’s room 9 in writing on a notification and consent form prescribed 10 by the department. If the resident has not affirmatively 11 objected to electronic monitoring and the resident’s medical 12 professional determines that the resident lacks the ability 13 to understand and appreciate the nature and consequences of 14 electronic monitoring, the resident representative may consent 15 on behalf of the resident. For purposes of this subsection, 16 a resident affirmatively objects when the resident orally, 17 visually, or through the use of auxiliary aids or services 18 declines electronic monitoring. The resident’s response shall 19 be documented on the notification and consent form. 20 2. Prior to a resident representative consenting on behalf 21 of a resident, the resident shall be asked if the resident 22 wants electronic monitoring to be conducted. The resident 23 representative shall explain all of the following to the 24 resident: 25 a. The type of electronic monitoring device to be used. 26 b. The standard conditions or restrictions that may be 27 placed on the electronic monitoring device’s use including as 28 specified in the list of standard conditions or restrictions 29 contained in the notification and consent form completed by the 30 resident as provided in section 135E.6. 31 c. The dissemination and use of any recording as provided 32 under sections 135E.10 and 135E.11. 33 d. The resident’s ability to decline all recordings. 34 3. A resident, or resident representative when consenting 35 -2- LSB 5557YH (6) 89 pf/rh 2/ 11
H.F. 2205 on behalf of the resident, may consent to electronic monitoring 1 with any conditions or restrictions of the resident’s or 2 resident representative’s choosing, including the list 3 of standard conditions or restrictions contained in the 4 notification and consent form completed by the resident 5 as provided in section 135E.6. A resident, or resident 6 representative when consenting on behalf of the resident, may 7 request that the electronic monitoring device be turned off 8 or the visual or audio recording component of the electronic 9 monitoring device be blocked at any time. 10 4. Prior to implementing electronic monitoring, a resident, 11 or resident representative when acting on behalf of the 12 resident, shall obtain the written consent on the notification 13 and consent form of any other resident who is a roommate 14 residing in the shared room. A roommate’s or roommate’s 15 resident representative’s written consent shall comply with 16 the requirements of this section. Consent by a roommate or 17 a roommate’s resident representative under this subsection 18 authorizes the resident’s use of any recording obtained under 19 this section as provided under sections 135E.10 and 135E.11. 20 5. Any resident conducting electronic monitoring shall 21 immediately remove or disable an electronic monitoring device 22 prior to a new resident who will be a roommate moving into 23 a shared room, unless the resident conducting electronic 24 monitoring obtains the new roommate’s or new roommate’s 25 resident representative’s written consent as provided under 26 this section prior to the new roommate moving into the shared 27 room. Upon obtaining the new roommate’s or new roommate’s 28 resident representative’s signed notification and consent form 29 and submitting the form to the nursing facility as required 30 under section 135E.5, the resident may resume electronic 31 monitoring. 32 6. The resident or roommate, or the resident representative 33 or roommate’s resident representative if the representative is 34 consenting on behalf of the resident or roommate, may withdraw 35 -3- LSB 5557YH (6) 89 pf/rh 3/ 11
H.F. 2205 consent at any time and the withdrawal of consent shall be 1 documented on the original consent form as provided under 2 section 135E.5. 3 Sec. 5. NEW SECTION . 135E.4 Refusal of roommate to consent. 4 If a resident of a nursing facility who is residing in a 5 shared room, or the resident representative of such a resident 6 when acting on behalf of the resident, wants to conduct 7 electronic monitoring and another resident living in or moving 8 into the same shared room refuses to consent to the use of an 9 electronic monitoring device, the nursing facility shall make 10 a reasonable attempt to accommodate the resident who wants to 11 conduct electronic monitoring. A nursing facility has met 12 the requirement to make a reasonable attempt to accommodate 13 a resident or resident representative who wants to conduct 14 electronic monitoring when, upon notification that a roommate 15 has not consented to the use of an electronic monitoring device 16 in the resident’s room, the nursing facility offers to move one 17 of the residents to another shared room that is available at 18 the time of the request that accommodates the resident. If 19 a resident chooses to reside in a private room in order to 20 accommodate the use of an electronic monitoring device, the 21 resident shall be subject to a private room rate. If a nursing 22 facility is unable to accommodate a resident due to lack of 23 space, the nursing facility shall reevaluate the request 24 periodically until the request is fulfilled. 25 Sec. 6. NEW SECTION . 135E.5 Notice and consent form 26 submitted to nursing facility. 27 1. Electronic monitoring may begin only after the resident 28 or resident representative who intends to place an electronic 29 monitoring device in the resident’s room and any roommate or 30 roommate’s resident representative completes a notification and 31 consent form and submits the form to the nursing facility. 32 2. Upon receipt of the required, completed notification and 33 consent form, the nursing facility shall place the original 34 form in the resident’s file, and a copy of the form in any 35 -4- LSB 5557YH (6) 89 pf/rh 4/ 11
H.F. 2205 roommate’s file. The nursing facility shall provide a copy to 1 the resident and the resident’s roommate, as applicable. 2 3. If a resident or roommate, or the resident representative 3 or roommate’s resident representative if the representative 4 is consenting on behalf of the resident or roommate, chooses 5 to alter the conditions under which consent to electronic 6 monitoring is given or chooses to withdraw consent to 7 electronic monitoring, the nursing facility shall make 8 available the original notification and consent form so that 9 the original form may be updated. Upon receipt of the updated 10 original form, the nursing facility shall place the updated 11 original form in the resident’s file. The nursing facility 12 shall provide a copy of the updated form to the resident and 13 the resident’s roommate, as applicable. 14 4. If a new roommate, or the new roommate’s resident 15 representative when consenting on behalf of the new roommate, 16 does not consent to electronic monitoring and submit a 17 completed notification and consent form to the nursing 18 facility, and the resident conducting the electronic monitoring 19 does not remove or disable an existing electronic monitoring 20 device, the nursing facility shall remove the electronic 21 monitoring device. 22 5. If a roommate, or the roommate’s resident representative 23 when withdrawing consent on behalf of the roommate, submits 24 an updated notification and consent form withdrawing consent 25 and the resident conducting electronic monitoring does not 26 remove or disable the electronic monitoring device, the nursing 27 facility shall remove the electronic monitoring device. 28 Sec. 7. NEW SECTION . 135E.6 Notification and consent form 29 requirements. 30 1. The notification and consent form completed by the 31 resident shall include, at a minimum, all of the following 32 information: 33 a. The resident’s signed consent to electronic monitoring or 34 the signature of the resident representative, if applicable. 35 -5- LSB 5557YH (6) 89 pf/rh 5/ 11
H.F. 2205 If a resident representative signs the consent form, the form 1 shall document all of the following: 2 (1) The date the resident was asked if the resident wants 3 electronic monitoring to be conducted. 4 (2) Any person present when the resident was asked. 5 (3) An acknowledgment that the resident did not 6 affirmatively object. 7 (4) The source of authority allowing the resident 8 representative to sign the notification and consent form on the 9 resident’s behalf. 10 b. The resident’s roommate’s signed consent or the signature 11 of the roommate’s resident representative, if applicable. If a 12 roommate’s resident representative signs the consent form, the 13 form shall document all of the following: 14 (1) The date the roommate was asked if the roommate wants 15 electronic monitoring to be conducted. 16 (2) Any person present when the roommate was asked. 17 (3) An acknowledgment that the roommate did not 18 affirmatively object. 19 (4) The source of authority allowing the resident 20 representative to sign the notification and consent form on the 21 roommate’s behalf. 22 c. The type of electronic monitoring device to be used. 23 d. Any installation needs, such as mounting of a device to 24 a wall or ceiling. 25 e. The proposed date of installation for scheduling 26 purposes. 27 f. A copy of any contract for maintenance of the electronic 28 monitoring device by a commercial entity. 29 g. A list of standard conditions or restrictions that the 30 resident or a roommate may elect to place on the use of the 31 electronic monitoring device including but not limited to all 32 of the following: 33 (1) Prohibiting audio recording. 34 (2) Prohibiting video recording. 35 -6- LSB 5557YH (6) 89 pf/rh 6/ 11
H.F. 2205 (3) Prohibiting broadcasting of audio or video. 1 (4) Turning off the electronic monitoring device or 2 blocking the visual recording component of the electronic 3 monitoring device for the duration of an exam or procedure by a 4 health care professional. 5 (5) Turning off the electronic monitoring device or 6 blocking the visual recording component of the electronic 7 monitoring device while dressing or bathing is performed. 8 (6) Turning off the electronic monitoring device for 9 the duration of a visit with a spiritual adviser, ombudsman, 10 attorney, financial planner, intimate partner, or other 11 visitor. 12 h. Any other condition or restriction elected by the 13 resident or roommate on the use of an electronic monitoring 14 device. 15 i. A statement of the circumstances under which a recording 16 may be disseminated under section 135E.10. 17 j. A signature box to document if the resident or roommate 18 withdraws consent. 19 2. A nursing facility shall make the notification and 20 consent form available to the residents and inform residents of 21 the option to conduct electronic monitoring of the resident’s 22 room. 23 Sec. 8. NEW SECTION . 135E.7 Cost and installation. 24 1. A resident who chooses to conduct electronic monitoring 25 shall do so at the resident’s own expense, including payment of 26 any purchase, installation, maintenance, and removal costs. 27 2. If a resident chooses to place an electronic monitoring 28 device that uses internet technology for visual or audio 29 monitoring, the resident may be responsible for contracting 30 with an internet service provider. 31 3. The nursing facility shall make a reasonable attempt 32 to accommodate the resident’s installation needs, including 33 allowing access to the nursing facility’s public-use internet 34 or wi-fi systems when available for other public uses. 35 -7- LSB 5557YH (6) 89 pf/rh 7/ 11
H.F. 2205 4. All electronic monitoring device installations and 1 supporting services shall comply with the requirements of the 2 national fire protection association 101 life safety code. 3 5. A nursing facility shall not charge a resident a fee 4 for the costs of electricity used by the electronic monitoring 5 device. 6 Sec. 9. NEW SECTION . 135E.8 Notice to visitors. 7 1. A nursing facility shall post a sign at each nursing 8 facility entrance accessible to visitors that states 9 “Electronic monitoring devices may be present in the rooms of 10 residents to record persons and activities”. 11 2. A nursing facility shall post a sign clearly and 12 conspicuously at the entrance to a resident’s room where 13 electronic monitoring is being conducted. The notice shall 14 state “This room is electronically monitored”. 15 3. The nursing facility is responsible for installing and 16 maintaining the signage required in this section. 17 Sec. 10. NEW SECTION . 135E.9 Obstruction of electronic 18 monitoring devices. 19 1. A person shall not knowingly hamper, obstruct, tamper 20 with, or destroy an electronic monitoring device placed in 21 a resident’s room without the permission of the resident or 22 resident representative. 23 2. A person shall not knowingly hamper, obstruct, tamper 24 with, or destroy a video or audio recording obtained through 25 the use of an electronic monitoring device in accordance with 26 this chapter. 27 3. It is not a violation of this section for a person to 28 turn off the electronic monitoring device or block the visual 29 recording component of the electronic monitoring device at the 30 direction of the resident or resident representative, or if 31 consent has been withdrawn. 32 4. A person who violates this section is guilty of a serious 33 misdemeanor. 34 Sec. 11. NEW SECTION . 135E.10 Dissemination of recordings. 35 -8- LSB 5557YH (6) 89 pf/rh 8/ 11

A person shall not access any video or audio recording 1 created through electronic monitoring under this chapter 2 without the written consent of the resident or resident 3 representative. 4 2. Except as otherwise required by law, a recording or copy 5 of a recording created as provided in this chapter may only be 6 disseminated for the purpose of addressing health, safety, or 7 welfare concerns of a resident. 8 3. A person accessing or disseminating a recording or copy 9 of a recording created as provided in this section in violation 10 of this section is guilty of a serious misdemeanor. 11 Sec. 12. NEW SECTION . 135E.11 Admissibility of evidence. 12 Subject to applicable rules of evidence and procedure, any 13 video or audio recording created through electronic monitoring 14 under this chapter may be admitted into evidence in a civil, 15 criminal, or administrative proceeding if the contents of the 16 recording have not been edited or artificially enhanced and the 17 recording includes the date and time the events occurred. 18 Sec. 13. NEW SECTION . 135E.12 Liability —— penalties. 19 1. A nursing facility is not civilly or criminally liable 20 for the disclosure of a recording by a resident or a person who 21 consents on behalf of a resident for any purpose not authorized 22 by this chapter. 23 2. A nursing facility is not civilly or criminally liable 24 for a violation of a resident’s right to privacy arising out 25 of any electronic monitoring conducted in accordance and in 26 compliance with this chapter. 27 3. A nursing facility that knowingly violates this chapter 28 shall be subject to licensee discipline pursuant to chapter 29 135C. 30 Sec. 14. NEW SECTION . 135E.13 Resident protections. 31 1. A nursing facility shall not do any of the following: 32 a. Refuse to admit a potential resident or remove a resident 33 because the nursing facility disagrees with the potential 34 resident’s or the resident’s decisions regarding electronic 35 -9- LSB 5557YH (6) 89 pf/rh 9/ 11
H.F. 2205 monitoring, whether the decision is made by a resident or a 1 resident representative acting on behalf of the resident. 2 b. Retaliate or discriminate against any resident for 3 consenting or refusing to consent to electronic monitoring. 4 c. Prevent the placement or use of an electronic monitoring 5 device by a resident who has provided the nursing facility 6 with the notification and consent form as required under this 7 chapter. 8 2. Any contractual provision prohibiting, limiting, or 9 otherwise modifying the rights and obligations in this chapter 10 is contrary to public policy and is void and unenforceable. 11 Sec. 15. NEW SECTION . 135E.14 Report to department. 12 A nursing facility shall report to the department, in a 13 manner prescribed by the department, the number of electronic 14 monitoring device notification and consent forms received by 15 the nursing facility on an annual basis. 16 Sec. 16. DIRECTIVE TO DEPARTMENT OF INSPECTIONS AND 17 APPEALS. The department of inspections and appeals shall 18 prescribe by rule pursuant to chapter 17A the notification and 19 consent form described in this Act, and shall make the form 20 available on the department’s internet site. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This bill provides for authorized electronic monitoring in 25 nursing facilities including the portion of the Iowa veterans 26 home licensed as a nursing facility. The bill shall be known 27 as “Evelyn’s Law”. 28 The bill provides that a nursing facility resident or a 29 resident representative may conduct electronic monitoring 30 of the resident’s room through the use of electronic 31 monitoring devices placed in the resident’s room pursuant 32 to the bill. The bill specifies the consents that must be 33 obtained for a resident to conduct electronic monitoring 34 in the resident’s room, including from any roommate; the 35 -10- LSB 5557YH (6) 89 pf/rh 10/ 11
H.F. 2205 process to be followed if a roommate refuses to consent; the 1 provision of notice to the nursing facility; the notification 2 and consent form requirements; the responsibility for the 3 cost and installation relating to the electronic monitoring; 4 penalties for obstruction of electronic monitoring devices; 5 the dissemination of recordings created through electronic 6 monitoring; the admissibility of evidence created through 7 electronic monitoring; liability and penalties for violations 8 of the bill; resident protections; and reporting requirements. 9 The bill also directs the department of inspections and appeals 10 to prescribe the notification and consent form described in 11 the bill and to make the form available on the department’s 12 internet site. 13 -11- LSB 5557YH (6) 89 pf/rh 11/ 11
