H.F. 2185 Section 1. Section 321.24, subsections 3 and 9, Code 2024, 1 are amended to read as follows: 2 3. The certificate of title shall must contain upon its 3 face the identical information required upon the face of the 4 registration receipt. In addition, the certificate of title 5 shall must contain a statement of the owner’s title, the 6 title number assigned to the owner or owners of the vehicle, 7 the name and address of the previous owner, and a statement 8 of all security interests and encumbrances as shown in the 9 application, upon the vehicle described, including the nature 10 of the security interest, date of perfection, and name and 11 mailing address of the secured party. 12 9. The county treasurer or the department shall maintain 13 in the county or department records system the information 14 contained on the certificate of title and the name and 15 address of the previous owner . The information shall must be 16 accessible by title certificate number for a period of three 17 years from the date of notification of cancellation of title 18 or date that a new title has been issued as provided in this 19 chapter . Copies the department requires shall be sent to 20 the department in the manner and at the time the department 21 directs. The department shall designate a uniform system of 22 title numbers to indicate the county of issuance. 23 Sec. 2. Section 321.31, subsection 1, paragraph a, Code 24 2024, is amended to read as follows: 25 a. The department shall install and maintain a records 26 system which shall must contain the name and address of the 27 vehicle owner, current and previous registration number, 28 vehicle identification number, make, model, style, date of 29 purchase, registration certificate number, maximum gross 30 weight, weight, list price or value of the vehicle as fixed 31 by the department, fees paid , and date of payment , and the 32 name and address of the previous owner . The records system 33 shall must also contain a record of the certificate of title 34 including such information as the department deems necessary. 35 -1- LSB 5368HV (2) 90 th/ns 1/ 2
H.F. 2185 The information to be kept in the records system shall be 1 entered within forty-eight hours after receipt insofar as is 2 practical. The records system shall constitute the permanent 3 record of ownership of each vehicle titled under the laws of 4 this state. 5 Sec. 3. Section 321.31, subsection 2, paragraph a, Code 6 2024, is amended to read as follows: 7 a. Each county treasurer’s office shall maintain a county 8 records system for vehicle registration and certificate of 9 title documents. The records system shall must consist of 10 information from the certificate of title, including the 11 date of perfection and cancellation of security interests, 12 and information from the registration receipt , and the name 13 and address of the previous owner . The information shall be 14 maintained in a manner approved by the department. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill strikes the requirement for a certificate of 19 title issued for a vehicle to contain the name and address 20 of the previous owner, and instead requires the department 21 of transportation (DOT) or county treasurer to maintain the 22 previous owner’s information in the DOT’s or county treasurer’s 23 records systems along with the other certificate of title 24 information. 25 -2- LSB 5368HV (2) 90 th/ns 2/ 2
