2 including penalties.

1 1 Section 1. Section 483A.8, subsection 2, Code 2016, is
1 2 amended to read as follows:
1 3 2. a. The deer hunting license shall be accompanied by
1 4 a tag designed to be used only once. When a deer is taken,
1 5 the deer shall be tagged and the tag shall be dated. The tag
1 6 shall be attached to the carcass of a deer taken within fifteen
1 7 minutes of the time the deer carcass is located after being
1 8 taken, or before the carcass is moved to be transported by any
1 9 means from the place where the deer was taken, whichever occurs
1 10 first. For each antlered deer taken, the tag shall be affixed
1 11 to the deer's antlers.
1 12 b. For purposes of the tagging requirements in this
1 13 subsection, a deer carcass may be moved away from an obstacle,
1 14 entanglement, waterway, or any other area, including but not
1 15 limited to a roadway, if tagging the carcass at that location
1 16 would be a safety hazard to the hunter or a third person,
1 17 before the tag is attached to the carcass. However, the
1 18 carcass shall not be moved from the immediate vicinity of where
1 19 the deer was taken, shall be moved only so far as is necessary
1 20 to avoid the obstacle, entanglement, waterway, or other safety
1 21 hazard, and shall be tagged immediately upon being so moved and
1 22 before being moved to be transported.
1 23 EXPLANATION
1 24 The inclusion of this explanation does not constitute agreement with
1 25 the explanation's substance by the members of the general assembly.
1 26 This bill provides that for purposes of requirements that
1 27 a deer carcass must be affixed with a tag before being moved
1 28 for transport, the carcass can be moved away from an obstacle,
1 29 entanglement, waterway, or any area, including but not limited
1 30 to a roadway, if tagging the carcass at that location would be
1 31 a safety hazard to the hunter or a third person, before the tag
1 32 is attached. The bill also provides that the carcass shall
1 33 not be moved from the immediate vicinity of where the deer was
1 34 taken, shall be moved only so far as is necessary to avoid the
1 35 safety hazard, and shall be immediately tagged upon being so
2 1 moved and before being moved to be transported. A violation
2 2 of the bill's provisions is punishable with a scheduled fine
2 3 of $25.
