H.F. 2177 Section 1. NEW SECTION . 279.76 Parental monitoring of 1 classroom activities —— live video feeds. 2 1. a. A school district shall have a camera in each 3 classroom not designated for special education or physical 4 education. The cameras shall be connected to the internet and 5 provide the ability for a parent or guardian of a child in a 6 classroom to obtain access to view the live footage of the 7 camera connected to the child’s classroom. 8 b. Expenses related to the installation and maintenance of 9 classroom cameras and related services and hardware necessary 10 to maintain live footage of classrooms shall be paid from 11 school foundation aid received by the school district under 12 section 257.16. 13 2. A school district shall restrict the access to view live 14 footage of cameras in its classrooms so that only a parent 15 or guardian of a child in the classroom may view the footage 16 during hours in which students are in normal attendance. 17 3. a. An employee of a school district who intentionally 18 obstructs, disconnects, or otherwise causes a camera or online 19 site not to function in a way that complies with subsection 1 20 shall be guilty of noncompliance. 21 b. A first offense of noncompliance is punishable by a 22 written reprimand. 23 c. A second offense of noncompliance is punishable by a fine 24 equivalent to one percent of the employee’s weekly salary. 25 d. A third or subsequent offense of noncompliance is 26 punishable by a fine equivalent to five percent of the 27 employee’s weekly salary. 28 4. A superintendent of a school district who fails to 29 cause an employee of a school district to comply with the 30 requirements of subsection 1 shall be subject to a fine 31 equivalent to five percent of the superintendent’s weekly 32 salary each time an employee of the superintendent’s school 33 district is fined pursuant to subsection 3, paragraph “d” . 34 EXPLANATION 35 -1- LSB 5265YH (3) 89 dg/jh 1/ 2

H.F. 2177 The inclusion of this explanation does not constitute agreement with 1 the explanation’s substance by the members of the general assembly. 2 This bill relates to parental access to live video feeds of 3 public school district classrooms and provides for penalties. 4 The bill requires each public school district to install 5 cameras in every classroom not designated for special education 6 or physical education so that parents and guardians of children 7 may view live footage of their children’s classrooms. 8 The bill provides that expenses related to the installation 9 and maintenance of classroom cameras and related services and 10 hardware necessary to maintain live footage of classrooms shall 11 be paid from school foundation aid. 12 The bill requires a school district to restrict the access 13 to view live footage of cameras in its classrooms so that 14 only a parent or guardian of a child in the classroom may 15 view the footage during hours in which students are in normal 16 attendance. 17 The bill provides that an employee of a school district 18 who intentionally obstructs, disconnects, or otherwise 19 causes a camera or online site not to function in a way that 20 complies with requirements for classroom cameras is guilty of 21 noncompliance. An employee guilty of noncompliance shall be 22 subject to a written reprimand for a first offense; a fine 23 equivalent to 1 percent of the employee’s weekly salary for 24 a second offense; and a fine equivalent to 5 percent of the 25 employee’s weekly salary for a third or subsequent offense. 26 The bill provides that a superintendent of a school district 27 who fails to cause an employee of a school district to comply 28 with the requirements for classroom cameras shall be subject to 29 a fine equivalent to 5 percent of the superintendent’s weekly 30 salary each time an employee of the superintendent’s school 31 district is guilty of noncompliance for a third or subsequent 32 time. 33 -2- LSB 5265YH (3) 89 dg/jh 2/ 2
