H.F. 2174 Section 1. ELECTION MANAGEMENT SYSTEMS —— AUDITING. 1 1. The state commissioner of elections shall commission an 2 independent private cyber security firm to perform an audit of 3 election management systems in nine counties, randomly selected 4 as follows: 5 a. Three counties with a population of forty thousand or 6 greater, one of which utilizes systems manufactured by unisyn, 7 one of which utilizes systems manufactured by election systems 8 and software, and one of which utilizes systems manufactured 9 by dominion. 10 b. Three counties with a population of greater than ten 11 thousand but fewer than forty thousand, one of which utilizes 12 systems manufactured by unisyn, one of which utilizes systems 13 manufactured by election systems and software, and one of which 14 utilizes systems manufactured by dominion. 15 c. Three counties with a population of ten thousand or 16 fewer, one of which utilizes systems manufactured by unisyn, 17 one of which utilizes systems manufactured by election systems 18 and software, and one of which utilizes systems manufactured 19 by dominion. 20 2. The audit shall capture a forensic image of examined 21 election management systems, which shall include voting 22 machines, software, and servers, and which shall cover the time 23 period beginning on September 1, 2020, and ending on the day 24 the image is created. The server traffic of the forensic image 25 shall be analyzed, including packet captures showing whether 26 all activity was authorized and showing the origin of each 27 internet service protocol address present on the image. 28 3. The state commissioner of elections shall publish 29 necessary qualifications that an independent private cyber 30 security firm must meet to perform an audit under this section. 31 4. The state commissioner shall request proposals from 32 independent private cyber security firms to perform an audit 33 under this section, and shall select a firm that meets the 34 requirements published pursuant to subsection 3. 35 -1- LSB 5801YH (4) 89 ss/jh 1/ 2

The independent private cyber security firm selected by 1 the state commissioner of elections shall submit a report of 2 its findings to the state commissioner of elections and general 3 assembly by October 1, 2022. 4 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 5 importance, takes effect upon enactment. 6 EXPLANATION 7 The inclusion of this explanation does not constitute agreement with 8 the explanation’s substance by the members of the general assembly. 9 This bill relates to audits of county voting systems. The 10 bill requires the state commissioner of elections to request 11 proposals from independent cyber security firms to perform 12 forensic audits of county voting systems. The bill includes 13 requirements for which systems shall be audited. The state 14 commissioner of elections shall publish requirements that an 15 independent cyber security firm must meet in order to perform 16 the audit. The firm selected by the state commissioner of 17 elections shall capture a forensic image of the voting systems 18 to be examined and shall analyze the server traffic in the 19 image, including packet captures and the origin of each 20 internet security protocol address that accessed the server. 21 The firm shall submit a report of its findings to the state 22 commissioner of elections and the general assembly by October 23 1, 2022. 24 The bill takes effect upon enactment. 25 -2- LSB 5801YH (4) 89 ss/jh 2/ 2
