H.F. 2155 Section 1. Section 100C.1, Code 2020, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 8A. “False alarm” means the activation of 3 an alarm system when a situation requiring emergency response 4 does not actually exist. For purposes of this chapter, “false 5 alarm” does not include the activation of an alarm system as a 6 result of weather conditions. 7 Sec. 2. Section 100C.6, subsection 1, Code 2020, is amended 8 to read as follows: 9 1. Relieve any person from payment of any local permit or 10 building fee , except as provided in section 100C.11 . 11 Sec. 3. NEW SECTION . 100C.11 Alarm systems —— fees or fines 12 —— limitations. 13 A political subdivision shall not adopt or enforce an 14 ordinance, resolution, rule, or other measure requiring an 15 alarm system contractor to pay a fee or fine associated with 16 any of the following: 17 1. False alarms. 18 2. Emergency response to false alarms. 19 3. Permits associated with placing or keeping an alarm 20 system in service, not including any installation permits 21 required by the political subdivision’s building code. 22 Sec. 4. NEW SECTION . 100C.12 Collection of fees. 23 1. If, prior to the effective date of this Act, an alarm 24 system contractor charged its customers an amount equal to the 25 costs the political subdivision of the state imposed on the 26 alarm system contractor for permits associated with placing 27 or keeping an alarm in service, as shown on a separate line 28 item on the customer’s invoice, the alarm system contractor 29 may continue to collect from its customers such fees until 30 December 31, 2020. The alarm system contractor shall pay 31 to the political subdivision of the state or its designee 32 the fees collected under this section in accordance with the 33 instructions of the political subdivision or the political 34 subdivision’s designee. 35 -1- LSB 5307YH (5) 88 ja/rn 1/ 2
H.F. 2155 2. Fees collected by an alarm system contractor under 1 this section shall not be subject to audit by a political 2 subdivision or the political subdivision’s designee. 3 Sec. 5. EFFECTIVE DATE. This Act, being deemed of immediate 4 importance, takes effect upon enactment. 5 EXPLANATION 6 The inclusion of this explanation does not constitute agreement with 7 the explanation’s substance by the members of the general assembly. 8 This bill prohibits political subdivisions from adopting 9 or enforcing an ordinance, resolution, rule, or other measure 10 requiring an alarm system contractor to pay a fee or fine 11 associated with false alarms, emergency response to false 12 alarms, or permits associated with placing or keeping an 13 alarm system in service. This prohibition does not apply to 14 installation permits required by a political subdivision’s 15 building code. 16 The bill also provides that if prior to the effective date 17 of the bill an alarm system contractor passed the costs of 18 installation permits to a customer as shown on a separate line 19 item on the customer’s invoice, the alarm system contractor may 20 continue to collect the fees from the customer until December 21 31, 2020. The bill provides that the alarm system contractor 22 is required to pay the fees to the political subdivision or 23 its designee. The bill prohibits a political subdivision from 24 auditing the alarm system contractor’s collection of the fees. 25 The bill takes effect upon enactment. 26 -2- LSB 5307YH (5) 88 ja/rn 2/ 2
