NEW SECTION. 719.9 Use of unmanned aerial 1 2 vehicle == prohibitions. 1 3 1. As used in this section: 1 4 a. "Facility" means a county jail, municipal holding 1 5 facility, secure facility for the detention or custody 1 6 of juveniles, community=based correctional facility, or 1 7 institution under the management of the department of 1 8 corrections. 1 9 b. "Unmanned aerial vehicle" means a vehicle or device 1 10 that uses aerodynamic forces to achieve flight and is piloted 1 11 remotely. 1 12 2. A person shall not operate an unmanned aerial vehicle 1 13 knowing that the unmanned aerial vehicle is operating in, on, 1 14 or above a facility and any contiguous real property comprising 1 15 the surrounding grounds of the facility, unless the unmanned 1 16 aerial vehicle is operated by a law enforcement agency or the 1 17 person has permission from the authority in charge of the 1 18 facility to operate an unmanned aerial vehicle in, on, or above 1 19 such facility. 1 20 3. A person who violates this section commits a class "D" 1 21 felony. 1 22 EXPLANATION 1 23 The inclusion of this explanation does not constitute agreement with 1 24 the explanation's substance by the members of the general assembly. 1 25 This bill relates to operating an unmanned aerial vehicle 1 26 in, on, or above a county jail, municipal holding facility, 1 27 detention facility for juveniles, community=based correctional 1 28 facility, or institution under the management of the department 1 29 of corrections. 1 30 The bill defines "unmanned aerial vehicle" to mean a vehicle 1 31 or device that uses aerodynamic forces to achieve flight and is 1 32 piloted remotely. 1 33 Under the bill, a person shall not operate an unmanned 1 34 aerial vehicle knowing that the unmanned aerial vehicle is 1 35 operating in, on, or above such a facility and any contiguous 2 1 real property comprising the surrounding grounds of the 2 2 facility, unless the unmanned aerial vehicle is operated by a 2 3 law enforcement agency or the person has permission from the 2 4 authority in charge of the facility to operate an unmanned 2 5 aerial vehicle in, on, or above such facility. 2 6 A person who violates the bill commits a class "D" felony.
