  1  1    Section 1.  Section 216E.1, Code 2018, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  14.  "Telecoil assistive device" means a
  1  4 tiny coil of wire around a core that supplements or replaces an
  1  5 input device within a hearing assistive device that will induce
  1  6 an electric current in the coil when it is in the presence of
  1  7 a magnetic field.
  1  8    Sec. 2.  NEW SECTION.  216E.5A  Telecoil assistive device
  1  9 notification requirements.
  1 10    1.  At the time of receiving a purchase order for a hearing
  1 11 assistive device is received, the assistive device dealer
  1 12 or assistive device lessor shall provide the consumer with
  1 13 written information pertaining to a telecoil assistive device,
  1 14 including all of the following:
  1 15    a.  The setting on the telecoil assistive device.
  1 16    b.  The compatibility of the telecoil assistive device
  1 17 with other assistive devices which are compliant with the
  1 18 federal Americans with Disabilities Act pursuant to 42 U.S.C.
  1 19 {12101=12117.
  1 20    2.  A consumer receiving the written information shall sign
  1 21 a copy of the written information which shall be retained by
  1 22 the assistive device dealer or assistive device lessor for the
  1 23 period corresponding to the number of years of warranty set out
  1 24 by the manufacturers.
  1 25    Sec. 3.  APPLICABILITY.  This Act applies to hearing
  1 26 assistive device purchase orders received on or after September
  1 27 1, 2018.
  1 28                           EXPLANATION
  1 29 The inclusion of this explanation does not constitute agreement with
  1 30 the explanation's substance by the members of the general assembly.
  1 31    This bill relates to telecoil assistive devices.
  1 32    The bill defines a telecoil assistive device as a tiny coil
  1 33 of wire around a core that supplements or replaces an input
  1 34 device within a hearing assistive device that will induce an
  1 35 electric current in the coil when it is in the presence of a
  2  1 magnetic field.
  2  2    The bill provides that at the time of receiving an order
  2  3 for a hearing assistive device, the consumer will be provided
  2  4 written information by the assistive device dealer or assistive
  2  5 device lessor related to a telecoil assistive device.
  2  6    The bill provides that the written information shall
  2  7 include the setting on the telecoil assistive device and the
  2  8 compatibility of the device with other assistive devices which
  2  9 are compliant with the Americans with Disabilities Act.
  2 10    The bill requires that a copy of the written information
  2 11 signed by the consumer be retained by the assistive device
  2 12 dealer or assistive device manufacturer for the period
  2 13 corresponding to the number of years of warranty set out by the
  2 14 manufacturer.
  2 15    The bill applies to telecoil purchase orders received on or
  2 16 after September 1, 2018.
