H.F. 212 Section 1. Section 279.58, subsection 1, Code 2011, is 1 amended by striking the subsection. 2 Sec. 2. Section 279.58, subsection 2, Code 2011, is amended 3 to read as follows: 4 2. The board of directors of a school district may adopt, 5 for the district or for an individual school within the 6 district, a dress code policy that prohibits students from 7 wearing gang-related or other specific apparel prescribes 8 standard dress, or that otherwise imposes limitations on 9 student dress without limiting a student’s constitutional 10 rights and privileges, if the board determines that the policy 11 is necessary for would improve the health, safety, or positive 12 educational environment of students and staff in the school 13 environment or for the appropriate discipline and operation of 14 the school. 15 3. Adoption and enforcement of a dress code policy pursuant 16 to this section is not a violation of section 280.22 . 17 Sec. 3. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 18 immediate importance, takes effect upon enactment. 19 EXPLANATION 20 This bill authorizes a school district to adopt, for the 21 school district or for an individual school, a dress code 22 policy that prescribes standard dress, or otherwise imposes 23 limitations on student dress without limiting a student’s 24 constitutional rights and privileges, if the board of directors 25 of the school district determines that the policy would improve 26 the health, safety, or positive educational environment of 27 students and staff in the school. 28 Currently, a school district is authorized to adopt a dress 29 code policy that prohibits students from wearing gang-related 30 or other specific apparel. 31 The bill takes effect upon enactment. 32 -1- LSB 1373HV (2) 84 kh/sc 1/ 1
