Sales
of
catalytic

converters
——
proof
——
penalty.

1.
A
person
shall
not
sell
a
catalytic
converter
or
any
3
nonferrous
part
of
a
catalytic
converter
unless
purchased
as
4
part
of
a
motor
vehicle
or
the
person
provides
the
vehicle
5
identification
number
of
the
vehicle
from
which
the
catalytic
6
converter
or
part
originated
and
reasonable
proof
of
any
of
the
7
following:
8
a.
The
person
owns
the
catalytic
converter
or
part.
9
Reasonable
proof
of
ownership
includes
but
is
not
limited
to
a
10
receipt
or
bill
of
sale.
11
b.
The
person
is
authorized
to
sell
the
catalytic
12
converter
or
part
on
behalf
of
the
owner.
Reasonable
proof
of
13
authorization
to
sell
the
property
includes
but
is
not
limited
14
to
a
signed
letter
on
the
owner’s
letterhead,
dated
no
more
15
than
ninety
days
before
the
date
of
sale,
authorizing
the
16
person
to
sell
the
property.

A
person
who
sells
a
catalytic
converter
or
any
18
nonferrous
part
of
a
catalytic
converter
in
violation
of
19
subsection
1
commits
a
serious
misdemeanor.

EXPLANATION
21
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
22
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Current
law
requires
all
scrap
metal
transactions
for
the
24
sale
of
catalytic
converters
totaling
more
than
$75
to
meet
25
certain
requirements.
A
person
who
sells
the
parts
must
26
provide
identifying
information
to
the
scrap
metal
dealer
and
27
the
dealer
must
keep
a
confidential
record
of
each
transaction.
28
In
addition,
payments
for
the
parts
must
be
made
by
check
29
or
electronic
funds
transfer.
A
person
who
violates
these
30
provisions
is
subject
to
a
civil
penalty
of
between
$100
and
31
$1,000.

This
bill
prohibits
the
sale
of
a
catalytic
converter
or
33
any
nonferrous
part
of
a
catalytic
converter
unless
it
is
34
purchased
as
part
of
a
motor
vehicle
or
the
person
selling

it
provides
the
vehicle
identification
number
of
the
vehicle
1
from
which
the
catalytic
converter
or
part
originated
and

reasonable
proof
that
the
person
owns
the
catalytic
converter

part

is
authorized
to
sell
the
property
on
behalf
of

the
owner.
Reasonable
proof
of
ownership
includes
but
is
not
5
limited
to
a

sale.
Reasonable
proof
of

authorization

sell
the
property
includes
but
is
not
limited

to
a

The
bill
applies
to
all
sales
of
catalytic

converters
or
nonferrous
parts
of
catalytic
converters,

not
otherwise
affect
the
requirements
under
current
law

for
scrap
metal
transactions
involving
catalytic
converters
13
totaling
more
than
$75.
14
A
person
who
sells
a
catalytic
converter
or
any
nonferrous
15
part
of
a
catalytic
converter
without
providing
the
required
16
information
commits
a
serious
misdemeanor.
A
serious
17
misdemeanor
is
punishable
by
confinement
for
no
more
than
one
18
year
and
a
fine
of
at
least
$430
but
not
more
than
$2,560.
