H.F. 2008 Section 1. Section 249A.15A, subsection 2, Code 2020, is 1 amended to read as follows: 2 2. The department shall adopt rules pursuant to chapter 3 17A entitling master social workers who hold a master’s 4 degree approved by the board of social work, are licensed as 5 a master social worker pursuant to section 154C.3, subsection 6 1 , paragraph “b” , and provide treatment services under the 7 supervision of an independent social worker licensed pursuant 8 to section 154C.3, subsection 1 , paragraph “c” a mental health 9 professional as defined in section 228.1, with the exception 10 of a mental health professional who is another licensed master 11 social worker , to payment for behavioral health services 12 provided to recipients of medical assistance, subject to 13 limitations and exclusions the department finds necessary on 14 the basis of federal laws and regulations. 15 Sec. 2. Section 514C.32, subsection 1, paragraph a, Code 16 2020, is amended to read as follows: 17 a. A licensed master social worker who is licensed by the 18 board of social work as a master social worker pursuant to 19 section 154C.3, subsection 1 , paragraph “b” , and who provides 20 services under the supervision of an independent social worker 21 licensed pursuant to section 154C.3, subsection 1 , paragraph 22 “c” a mental health professional as defined in section 228.1, 23 with the exception of a mental health professional who is 24 another licensed master social worker . 25 Sec. 3. Section 514C.32, subsection 5, Code 2020, is amended 26 to read as follows: 27 5. Nothing in this section shall be interpreted to require 28 an individual or group health maintenance organization or a 29 preferred provider organization or arrangement to provide 30 payment or prepayment for services provided by a licensed 31 master social worker providing behavioral health services 32 under the supervision of an independent social worker mental 33 health professional as defined in section 228.1, with the 34 exception of a mental health professional who is another 35 -1- LSB 5313YH (3) 88 pf/rh 1/ 3
H.F. 2008 licensed master social worker , or to a licensed mental health 1 counselor or licensed marital and family therapist who holds 2 a temporary license to practice mental health counseling or 3 marital and family therapy providing behavioral health services 4 under the supervision of a qualified supervisor, as specified 5 in this section , unless the supervising independent social 6 worker mental health professional or the qualified supervisor, 7 respectively, has entered into a contract or other agreement 8 to provide behavioral health services with the individual or 9 group health maintenance organization or the preferred provider 10 organization or arrangement. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill relates to the supervision requirements for the 15 provision of services by a licensed master social worker for 16 the purposes of reimbursement under the Medicaid program and 17 private insurance. 18 The bill provides that instead of requiring that supervision 19 be provided by a licensed independent social worker, 20 supervision is required by a mental health professional with 21 the exception of a mental health professional who is another 22 licensed master social worker. 23 Under the bill, “mental health professional” is defined 24 in current Code section 228.1 to mean an individual who has 25 either of the following qualifications: (1) holds at least a 26 master’s degree in a mental health field, including but not 27 limited to psychology, counseling and guidance, nursing, and 28 social work, or is an advanced registered nurse practitioner, 29 a physician assistant, or a physician and surgeon or an 30 osteopathic physician and surgeon; holds a current Iowa license 31 if practicing in a field covered by an Iowa licensure law; and 32 has at least two years of post-degree clinical experience, 33 supervised by another mental health professional, in assessing 34 mental health needs and problems and in providing appropriate 35 -2- LSB 5313YH (3) 88 pf/rh 2/ 3
H.F. 2008 mental health services, or (2) holds a current Iowa license if 1 practicing in a field covered by an Iowa licensure law and is 2 a psychiatrist, an advanced registered nurse practitioner who 3 holds a national certification in psychiatric mental health 4 care and is licensed by the board of nursing, a physician 5 assistant practicing under the supervision of a psychiatrist, 6 or an individual who holds a doctorate degree in psychology and 7 is licensed by the board of psychology. 8 -3- LSB 5313YH (3) 88 pf/rh 3/ 3
