NEW
SECTION
.
43.17
Disqualification
of
defeated

candidates.

1.
A
person
who
files
nomination
papers
pursuant
to
section
3
43.11
but
fails
to
receive
the
nomination
of
the
political
4
party
shall
not
be
eligible
for
election
to
the
office
listed
5
on
the
nomination
papers
in
the
next
general
election
for
that
6
office.

2.
Subsection
1
shall
not
apply
to
a
person
nominated
8
pursuant
to
section
43.23
to
replace
a
candidate
who
dies
or
9
withdraws
or
a
person
designated
to
fill
a
ballot
vacancy
10
pursuant
to
section
43.78.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
a
person
who
seeks
the
nomination
of
a

political
party
for
election
to
a
certain
office
but
loses
the
16
nomination
from
being
eligible
for
election
to
that
office
in
17
the
next
general
election
for
that
office.
The
bill
does
not
18
apply
to
a
person
nominated
to
replace
a
candidate
who
dies
or
19
withdraws
or
to
a
person
designated
to
fill
a
ballot
vacancy.
