SENATE RESOLUTION

 

 

requesting the President of the Senate and speaker of the house of representatives to convene a taskforce to review existing lawS relating to driving under the influence of an intoxicant and MAKE RECOMMENDATIONS ON HOW TO STRENGTHEN APPLICABLE LAWS.

 

 


     WHEREAS, according to a study conducted by WalletHub, Hawaii was ranked twenty-sixth in the nation for having the strictest driving under the influence laws; and

 

     WHEREAS, in another study conducted by Mothers Against Drunk Driving, Hawaii was ranked as the twenty-second worst state with drunk driving traffic fatalities; and

 

     WHEREAS, the National Transportation Safety Board recommended that all fifty states establish a per se blood alcohol content limit of 0.05 or lower in order to reduce the number of crashes, injuries, and fatalities; and

 

     WHEREAS, the blood alcohol content limit in Hawaii remains at 0.08 for drivers who are at least twenty-one years of age; and

 

     WHEREAS, the State needs to strengthen laws and enforcement to prevent first-time and repeat offenders who drive under the influence of an intoxicant; now, therefore,

 

     BE IT RESOLVED by the Senate of the Thirtieth Legislature of the State of Hawaii, Regular Session of 2019, that the President of the Senate and Speaker of the House of Representatives are requested to convene a task force to review existing law relating to driving under the influence of an intoxicant pursuant to section 291E-61, Hawaii Revised Statutes; and

 

     BE IT FURTHER RESOLVED that the task force include the:

 

     (1)  Chair of the Senate Committee on Judiciary, or its successor committee;

 

     (2)  Chair of the Senate Committee on Public Safety, Intergovernmental, and Military Affairs, or its successor committee;

 

     (3)  Chair of the House of Representative Committee on Judiciary, or its successor committee; and

 

     (4)  Chair of the House of Representatives Committee on Public Safety, Veterans, and Military Affairs, or its successor committee; and

 

     BE IT FURTHER RESOLVED that the task force is requested to submit a report of its findings and recommendations, including any proposed legislation, on how to strengthen the State's laws relating to driving under the influence of an intoxicant to prevent first-time and repeat offenders to the Legislature no later than twenty days prior to the convening of the Regular Session of 2020; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the President of the Senate; Speaker of the House of Representatives; Chair of the Senate Committee on Judiciary; Chair of the Senate Committee on Public Safety, Intergovernmental, and Military Affairs; Chair of the House of Representatives Committee on Judiciary; and Chair of the House of Representatives Committee on Public Safety, Veterans, and Military Affairs.
