SENATE RESOLUTION

 

 

URGING EACH COUNTY TO DEVELOP AND ADMINISTER A PERMITTING SYSTEM FOR NON-PERMITTED OWNER-OCCUPIED TRANSIENT VACATION UNITS.

 

 


     WHEREAS, the State and counties are working together to regulate illegal transient vacation units, which have become widespread throughout the State; and

 

     WHEREAS, the Hawaii Tourism Authority estimates that there are 27,177 transient vacation rentals in the State that are advertised online; and

 

     WHEREAS, across the State, 79.6 percent of all Airbnb listings are categorized as "entire place," meaning that the entire housing unit is being rented out to visitors; and

 

     WHEREAS, existing laws and ordinances allow transient vacation units to operate only in resort districts; however, the counties are seeking options to authorize owner-occupied units outside of resort districts to continue operating as short-term rentals; and

 

     WHEREAS, a county permitting system for those who operate owner-occupied transient vacation units will encourage owners to properly register their properties for short-term rental use; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2018, that this body urges each county to develop and administer a permitting system for non-permitted, owner-occupied transient vacation units; and

 

     BE IT FURTHER RESOLVED that this body urges each county to publicize the permitting system to maximize public awareness of and participation in the program and to contract with appropriate advertising agencies inside or outside the State to accomplish this goal; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Director of Planning and Permitting for the City and County of Honolulu, Planning Director for the County of Hawaii, Planning Director for the County of Kauai, Planning Director for the County of Maui, Chairperson of the Planning Commission for the City and County of Honolulu, Chairpersons of the Windward and Leeward Planning Commissions for the County of Hawaii, Chairperson of the Planning Commission for the County of Kauai, Chairperson of the Maui Planning Commission, Chairperson of the Molokai Planning Commission, and Chairperson of the Lanai Planning Commission.
