SENATE RESOLUTION
URGING THE COUNTIES TO IMPLEMENT AND ENFORCE REGULATIONS THAT ENSURE CAR SHARING SERVICES AND OPERATIONS DO NOT NEGATIVELY IMPACT THE TRAFFIC, PARKING, AND CHARACTER OF RESIDENTIAL NEIGHBORHOODS.
WHEREAS, visitor industry regulations protect the social, economic, and environmental needs of Hawaii's residents, local businesses, and visitors; and
WHEREAS, car sharing platforms like Turo enable residents to rent out their personal vehicles for short-term use to generate income; and
WHEREAS, persons who use car sharing platforms to rent out their personal vehicles often conduct business directly from their residential properties, potentially requiring a home occupation license in at least one county; and
WHEREAS, certain car owners park their vehicles in residential lots or along neighborhood streets that do not have the capacity to host non-residential vehicles; and
WHEREAS, when persons who use car sharing platforms to rent out their personal vehicles conduct business from their personal residence it can create traffic, noise, and safety concerns within neighborhoods; and
WHEREAS, persons who use car sharing platforms to rent out their personal vehicles violate residential parking space limits, take away parking spaces from other neighbors, and have a negative visual impact on neighborhoods because of their excess vehicles; and
WHEREAS, certain transportation industries, like taxi operators, are required to register with their county mass transit agency and have their business license signed off by the county planning office, who then may grant them additional parking for their lot; and
WHEREAS, it is important to ensure that car sharing operations do not negatively impact residential neighborhoods, that residents' rights are protected, and that these operations comply with local zoning and business ordinances; and
WHEREAS, if appropriate regulations do not already exist at the county level, the counties should enact ordinances that regulate car sharing services and operations; now, therefore,
BE IT RESOLVED by the Senate of the Thirty-second Legislature of the State of Hawaii, Regular Session of 2023, that the counties are urged to implement and enforce regulations that ensure that car sharing services and operations do not negatively impact the traffic, parking, and character of residential neighborhoods; and
BE IT FURTHER RESOLVED that any county regulations enacted are encouraged to protect the social, economic, and environmental needs of Hawaii; and
BE IT FURTHER RESOLVED that the counties are urged to limit peer-to-peer ride share parking on public streets as appropriate based on the needs of any given neighborhood; and
BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the mayor of each county, chair of each county council, and director of planning of each county.
