SENATE RESOLUTION

 

 

REQUESTING the DEPARTMENT OF ACCOUNTING AND GENERAL SERVICES TO FUND THE ESTABLISHMENT OF ONE FULL-TIME EQUIVALENT PROGRAM DIRECTOR POSITION, ONE FULL-TIME STAFF MEMBER POSITION, AND COSTS NECESSARY TO ESTABLISH A FULL-TIME STATE BUILDING CODE COUNCIL OFFICE.

 

 


     WHEREAS, the State Building Code Council (Council) was established by Act 82, Session Laws of Hawaii 2007, to create and implement a uniform set of statewide building codes applicable to all construction in the State, which is now known as the Hawaii State Building Codes; and

 

     WHEREAS, the health and safety considerations related to the Hawaii State Building Codes are matters of statewide concern; and

 

     WHEREAS, since its creation, the Council has struggled with limited funding and insufficient staffing; and

 

     WHEREAS, it is also a concern that the members of the Council may lack the requisite experience in and knowledge of building codes and the cost impacts of building code revisions; and

 

     WHEREAS, amendments to the Hawaii State Building Codes proposed by the private sector and others who may financially benefit from the adoption of the proposed amendments, especially amendments to codes that do not pertain to public health or safety, are often adopted without a cost benefit analysis; input from residential, commercial, and industrial builders; or consideration of the resulting increase in the overall cost of construction in Hawaii; and

 

     WHEREAS, the Council is also significantly burdened by its duty to update the Hawaii State Building Codes to conform to the International Building Code (IBC), since a new edition of the international code is published by the International Code Council every three years; and

 

     WHEREAS, with funding and permanent staff, the Council will be better able to update and adopt commercial and residential codes to meet the intent of Act 82, Session Laws of Hawaii 2007; now, therefore,

 

     BE IT RESOLVED by the Senate of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2022, that the Department of Accounting and General Services is requested to fully fund:

 

     (1)  The establishment of one full-time equivalent (1.0 FTE) program director position and one full-time equivalent (1.0 FTE) staff member position; and

 

     (2)  Employee training, materials and supplies, other costs associated with the Council, and costs necessary to establish a full-time State Building Code Council Office; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Resolution be transmitted to the Comptroller of the Department of Accounting and General Services.
